Unless otherwise expressly stated, the following words and phrases,
wherever used in this Civil Service Code, shall be construed to have
the meanings indicated herein:
APPLICANT
Any individual who applies in writing to the Commission in
response to a legally advertised notice of vacancy and/or examination
for any position in the Bureau of Police.
APPOINTING AUTHORITY
That person or group of persons, other than the Commission,
having power by virtue of statute or other lawful authority to exercise
executive control over the appointment, suspension, promotion, other
position change and discipline of a member of the police force or
a paid firefighter of the Township. Unless stated otherwise, all references
to "appointing authority" shall mean the Mayor.
BOARD OF COMMISSIONERS
The Whitehall Township Board of Commissioners, the municipal
legislative body of Whitehall Township, Lehigh County, Pennsylvania.
BUREAU OF POLICE
The structure established by the Township of Whitehall to
establish and maintain its police force.
CERTIFICATION
The submission to the appointing authority pursuant to their
request of three names taken from the eligible list developed by the
Civil Service Commission.
CERTIFIED LIST
The list of persons who have qualified through examination
and have met all other requirements for appointment to the classified
service. This list shall be arranged top to bottom, from the highest
test score to the lowest test score, in the order of the final weighted
composite score received by each applicant.
CHAIRPERSON
The duly elected Chairperson of the Civil Service Commission
of Whitehall Township.
COMMISSION
The Civil Service Commission of Whitehall Township, Pennsylvania.
COMMISSIONER
An individual appointed by the Township of Whitehall, Pennsylvania
to serve as a member of the Civil Service Commission.
CONSORTIUM TESTING
A collective of police departments who form memorandums of
understanding to conduct entry level testing for new hire candidates.
ELIGIBLE
A person whose name is recorded on a current eligibility
or furlough list.
ELIGIBLE LIST
The list of names of persons who have passed the most current
examination for a particular position in the Whitehall Township Bureau
of Police.
EXAMINATION
The group of tests and the background investigation given
to candidates to determine their qualifications for a position in
the regular police service.
FURLOUGH
The temporary separation of an employee from the classified
civil service because of reduction in personnel, resulting in the
placement of the furloughed employee's name on a reemployment list.
HUMAN RESOURCES OFFICER
Administrative position within the Township that is responsible
for, and coordinates the employment, hiring, benefits, personnel matters,
etc. for Township employees.
POLICE OFFICER
For purposes of these rules and regulations, an entry level
sworn full-time position in a state, municipal police department with
completion of basic training courses as approved by the Municipal
Police Officers Education and Training Commission. Also, to include
military police, special police, etc., as defined and established
by the respective branch of the United States Armed Services.
PROBATIONER
An officer in the Bureau of Police who has been appointed
from an eligible list, but who has not yet completed the work-test
period.
REDUCTION IN RANK
A change to a different position or rank where the employee
fulfilled all of the requirements of these rules and regulations for
both the prior and current position or rank. However, a decrease in
salary without a change to a different position or rank shall not
necessarily constitute a reduction in rank.
REMOVAL
The permanent separation of a police officer from the Bureau
of Police.
RESERVE COMPONENT OF THE ARMED FORCES
The United States Army Reserve, United States Navy Reserve,
United States Marine Corps Reserve, United States Coast Guard Reserve,
United States Air Force Reserve, Pennsylvania National Guard and Pennsylvania
Air National Guard.
RESIGNATION
The permanent separation of a police officer from the Bureau
of Police by the stated intent of the officer to supervisory personnel,
in writing to separate from employment at a designated date.
ROUND OF TESTING
The period of time which the Civil Service Commission establishes
for completion of new eligibility and promotional lists.
SECRETARY
The Secretary of the Civil Service Commission of Whitehall
Township.
STENOGRAPHER
Such stenographer as shall be designated from time to time
by the Commission.
SUSPENSION
The temporary separation with or without pay of a police
officer from the Bureau of Police.
VETERAN
An individual who has served in the armed forces of the United
States, including a reserve component and National Guard, and who
has been discharged or released from the service under conditions
other than dishonorable. Also including an applicant who served in
the National Guard or Reserves. Such service must include completion
of basic training and completion of either the entire first term of
service or at least one period of active duty for a purpose other
than training since August 2, 1990.

Also eligible are:
(1)
Widows or widowers of veterans.
(2)
Spouses of disabled veterans.
B.
Widows or widowers of veterans who remarry and/or divorced spouses
of disabled veterans are not eligible to receive veterans' preference
points.
Whenever the appointing authority shall deem it necessary to
reduce the number of Township police officers, the Commission shall
prepare and maintain a list of the names of all such furloughed officers
together with the position held by each officer at the time of furlough.
Names on the furlough list shall be arranged in priority order based
on the length of service of each furloughed officer.
The rules and regulations contained herein shall be printed
for public distribution at the expense of the Township. All the forms
contained within the Civil Service Commission Master Form Notebook
shall become the official forms of the Commission to effectuate these
rules and regulations, copies of which forms shall be available from
the Secretary of the Commission or the Office of the Township Mayor.
If any of these rules and regulations shall be deemed contrary
to law by any forum of competent jurisdiction, it is the stated intent
that the remaining provisions of these rules shall remain in full
force and effect as though the contrary provision had not been included.
