The City Council of the City of Pleasantville hereby finds and declares that the operation of any all-terrain vehicle or dirt bike on any public street, highway or right of way in violation of N.J.S.A. 39:3C-17 poses an immediate threat to the public health, safety or welfare. "All-terrain vehicle" and "dirt bike" shall have the meanings set forth in N.J.S.A. 39:3C-1.
In addition to all other powers granted under Title 39 of the New Jersey Statutes and the Pleasantville Municipal Code, the City's authorized enforcement authorities shall have the power to designate any all-terrain vehicles or dirt bikes which are operated in violation of N.J.S.A. 39:3C-17 as contraband, subject to immediate seizure and forfeiture pursuant to the provisions of N.J.S.A. 2C:64-1 eq seq. Any vehicle so forfeited may be disposed of in accordance with N.J.S.A. 2C:64-6, or destroyed, at the discretion of the City or such other entity as may have funded the agency which prosecuted the violation.
All ordinances and provisions thereof inconsistent with the provisions of this chapter shall be and are hereby repealed to the extent of such inconsistency.
If any section, paragraph, subdivision, clause or provision of this chapter shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision and the remainder of this chapter shall be deemed valid and effective.
