There is hereby created and established for the city, the Tulia
Depot and Historical Preservation Commission, which shall be composed
of five (5) members. At no time shall there be more than two (2) members
of the commission that are then currently on the city council, including
the mayor. Additionally, at least one member of the Swisher County
Historical Commission shall be appointed to the commission and at
least one representative from the Swisher County Archives and Museum
Association, being a member or members of the museum board of directors
and/or the museum director. The members shall be resident citizens
of the city, all of whom shall be appointed by the mayor, subject
to confirmation by the city council, to serve for terms of two (2)
years, except that three (3) of the initial members shall have two-year
terms and two (2) of the initial members shall have a one-year term
so that thereafter the members shall have staggered terms. All vacancies
shall be filled for the unexpired term of the member whose position
is vacant in the same manner as provided for the original appointment
of said vacant member. Members of the commission may be removed by
the mayor, with the consent of the city council, after public hearing
and for cause set forth in writing. The members of the commission
shall serve without compensation.

The Tulia Depot and Historical Preservation Commission shall
elect a chairman, vice-chairman and such other officers as they deem
appropriate from its membership. The commission shall adopt an annual
budget for restoration, improvements and maintenance of the Tulia
Depot and other historical sites in the city. The proposed budget
shall be presented to the city council for consideration and approval
as part of the city’s annual budget. The commission shall be
responsible for and establish procedures for the use and rental of
the Tulia Depot, which procedures shall not discriminate against any
person, organization or entity because of race, color, religion, sex,
handicap, familial status, or national origin. In addition, the commission
shall do and perform such other acts and duties as it may be called
upon to perform and do by the city manager or the city council.

The commission may provide for regular and special meetings
and adopt such rules and regulations for its own operation as deemed
advisable by its members, such to be approved by the city council.
All meetings of the commission shall be held in compliance with the
open meetings laws of the state. Additionally, the Swisher County
Historical Commission shall be entitled to hold their member and/or
officer meetings at the Tulia Depot without charge for use of the
facility.
