Animal control officer shall refer to the animal control officer, animal control authority, animal warden, police chief or his/her designees.

There is hereby created the office of animal warden. The animal warden shall be appointed by the city manager and shall perform such duties and receive such compensation as shall be prescribed by the city council and this chapter. He shall work under the supervision and direction of the chief of police, and shall be responsible to the chief of police, for the performance of his duties as animal warden.

Any reference in this chapter to “city tax collector” shall also include any person designated by the city manager to perform the duties or function assigned to the city tax collector under this chapter.

It shall be unlawful for any owner of any animal in its natural state or any animal usually confined to cages, pens, or restrained by lease, to permit any such animal to run at large or in any public place.

The owner or other person having the responsibility of caring for any nondomestic animal, fowl, or reptile shall not keep, maintain, or bring such animal, fowl, or reptile within the corporate limits, except under conditions as shall be set by the chief of police.

Any owner who shall willingly or negligently fail to restrain by cage, lease, pen or other manner any animal shall be guilty of maintaining a nuisance.

(a) 
It shall be unlawful for any person, firm or corporation to keep or cause to be kept, for any purpose whatsoever, any livestock within the corporate limits of the city, except that livestock may be held in an animal hospital, pound or shelter in a C-2 (general commercial) district or M (manufacturing) district for treatment at an animal hospital, pound or shelter by a licensed veterinarian.

The term “livestock” as used herein is defined to include all cattle, horses, asses, mules, sheep, swine, and goats.

Dangerous wild animals, as defined in V.T.C.A., Health and Safety Code, section 822.101, shall be regulated in accordance with the provisions of V.T.C.A, Health and Safety Code, chapter 822, subchapter E, section 822.101 et seq.
