A. 
Development, land disturbing activity, and encroachments in floodways shall not be authorized unless it has been demonstrated through hydrologic and hydraulic analyses required in accordance with § 94-39A of these regulations that the proposed encroachment will not result in any increase in the base flood level during occurrence of the base flood discharge. If § 94-39A is satisfied, proposed elevation, addition, or reconstruction of a lawfully existing structure within a floodway shall also be in accordance with § 94-80 of this chapter and the floodway requirements of N.J.A.C. 7:13.
B. 
Prohibited in floodways. The following are prohibited activities:
(1) 
The storage of unsecured materials is prohibited within a floodway pursuant to N.J.A.C. 7:13.
(2) 
Fill and new structures are prohibited in floodways per N.J.A.C. 7:13.
In coastal high hazard areas and Coastal A Zones:
A. 
New buildings shall only be authorized landward of the reach of mean high tide.
B. 
The placement of manufactured homes shall be prohibited except in an existing manufactured home park or subdivision.
C. 
Basements or enclosures that are below grade on all sides are prohibited.
D. 
The use of fill for structural support of buildings is prohibited.
All new and replaced sanitary sewer facilities, private sewage treatment plants (including all pumping stations and collector systems) and on-site waste disposal systems shall be designed in accordance with the New Jersey septic system regulations contained in N.J.A.C. 14A and N.J.A.C. 7:9A, the UCC Plumbing Subcode (N.J.A.C. 5:23) and Chapter 7, ASCE 24, to minimize or eliminate infiltration of floodwater into the facilities and discharge from the facilities into floodwaters, or impairment of the facilities and systems.
All new and replacement water facilities shall be designed in accordance with the New Jersey Safe Drinking Water Act (N.J.A.C. 7:10) and the provisions of Chapter 7, ASCE 24, to minimize or eliminate infiltration of floodwater into the systems.
Storm drainage shall be designed to convey the flow of surface waters to minimize or eliminate damage to persons or property.
Subject to the limitations of these regulations, fill shall be designed to be stable under conditions of flooding including rapid rise and rapid drawdown of floodwater, prolonged inundation, and protection against flood-related erosion and scour. In addition to these requirements, when intended to support buildings and structures (Zone A only), fill shall comply with the requirements of the UCC (N.J.A.C. 5:23). Proposed fill and encroachments in flood hazard areas shall comply with the flood storage displacement limitations of N.J.A.C. 7:13.
In coastal high hazard areas and Coastal A Zones, alteration of sand dunes shall be permitted only when the engineering analysis required by § 94-39D of these regulations demonstrates that the proposed alteration will not increase the potential for flood damage. Construction or restoration of dunes under or around elevated buildings and structures shall comply with § 94-87C of these regulations and as permitted under the NJ Coastal Zone Management Rules (N.J.A.C. 7:7).
The placement or storage of any containers holding hazardous substances in a flood hazard area is prohibited unless the provisions of N.J.A.C. 7:13 which cover the placement of hazardous substances and solid waste are met.
A. 
Filling of lots.
(1) 
No building permits shall be issued for new construction on any lands west of Central Avenue unless said land is raised to elevation 5.0 in NAVD 1988 Datum or a maximum of 20 inches above the edge of pavement street grade, measured at the midpoint of the lot. Should the property be above elevation 5.0, the fill required will be eight inches above the edge of pavement street grade. All applications for a building permit shall include a plot plan showing the existing and proposed grades in conformance with this subsection. The use of retaining walls will be required in order to contain the drainage and/or fill on the property, as directed by the code enforcement/zoning officer.
(2) 
In the case of additions, alterations or repairs to existing structures, the above requirements shall apply when:
(a) 
In the case of additions, alterations or repairs to existing structures west of Central Avenue, the above requirements shall apply when the size of additions, alterations or repairs exceed 75% of the square footage of the existing structure.
(b) 
When any structure, on a building lot, is moved from its existing foundation for the purpose of installing piling or to raise the structure to a higher elevation.
B. 
Draining.
(1) 
In order to ensure proper drainage and to avoid impacts to neighboring properties, all residential construction is required to maintain proper drainage. In lots that require fill, a drainage system of perforated and/or solid piping shall be installed to provide positive drainage and discharge to the municipal street. The developer of any lot may install a drainage system on one or both sides of the structure and all roof leaders shall be tied into the system for positive discharge at the roadway. Typical layout details are provided at the end of this chapter.[1]

C. 
Fees.
(1) 
In the event the Building Department determines that the plot plan must be reviewed by the Municipal Engineer, then the cost of said review shall be borne by the applicant.
(2) 
All other sections, subsections, paragraphs, subparagraphs and provisions of Chapter 88[2] shall remain in full force and effect.
