The owner of any parcel or lot of land in the borough which is below grade or which contains holes or depressions below street grade shall fill the same with a clean fill to the grade of the center of the street on which the lot fronts within 30 days after service upon him of a notice to make such fill.
In the event of failure of a property owner to make such fill within the time limit herein, such fill may be made by the borough, and in such event the cost thereof shall become a lien upon the lands involved and shall be added to and become a part of the taxes next to be assessed against and levied upon the lands, the same to bear interest at the same rate as taxes, and shall be collected and enforced by the same officers in the same manner as borough taxes on real property.
The notice required to be served upon the property owner shall be signed by the Secretary of the Board of Health and may be served upon all owners residing in the borough personally or by leaving the same at their usual place of abode with a member of the household above the age of 14 years. If the owner is not a borough resident, the notice may be served upon him personally or upon his agent in charge of the property or upon an occupant thereof or mailed to such nonresident owner at his address as shown upon the tax records of the borough.
Proof of affidavit of the service of such notice shall be filed in the office of the Tax Collector.
A violation of this chapter shall be punishable as provided in Chapter 1, General Provisions, § 1-15.
