For the purposes of this article, all definitions of words,
terms, and phrases as set forth in the Texas Alcoholic Beverage Code
are hereby adopted and made a part thereof.

(a) Sale
of alcoholic beverages for off-premises consumption shall be restricted
to premises located adjacent to Valley Mills Drive, New Road and Dutton
Avenue.
(b) Sale
of alcoholic beverages for on-premises consumption shall be restricted
to premises located adjacent to Valley Mills Drive and Dutton Avenue.
(c) The
sale of alcoholic beverages by a dealer whose place of business is
within 300 feet of a church, public school, or public hospital and
50 feet of a residence.
(d) The
measurement of the distance between the place of business where alcoholic
beverages are sold and the church or public hospital shall be along
the property lines of the street fronts and from front door to front
door, and in direct line across intersections. The measurement of
the distance between the place of business where alcoholic beverages
are sold and the public schools shall be from the nearest property
line of the public school to the nearest doorway by which the public
may enter the place of business, along street lines and in direct
line across intersections. For any permit or license covering a premises
where minors are prohibited from entering the premises under section
109.53 [of the Texas Alcoholic Beverage Code], the measurement of
the distance between the premises and a public school shall be along
the property lines of the street fronts and from front door to front
door, and in a direct line across intersections.

Conduct by any person at a place of business where the sale
of beer or wine at retail is authorized that is lewd, immoral, or
offensive to public decency is hereby declared to include but not
be limited to the following prohibited acts, and it shall be unlawful
for any person engaged in such business, or agent, servant or employee
of such person, to engage in or to permit such conduct on the premises
of the retailer:
(1) The
use or the permitting of the use of loud, vociferous, obscene, vulgar,
indecent or abusive language.
(2) Exposure
of person or permitting any person to expose his person.
(3) Displaying
or permitting any person to display a pistol or other deadly weapon
or switch blade knife in a manner calculated to disturb the inhabitants
of such place.
(4) Solicitation
of any person for coins to operate musical instruments or devices.
(5) Becoming
intoxicated on the licensed premises or permitting any intoxicated
person to remain on the premises.
(6) Permitting
solicitation of persons for immoral or sexual purposes or relations.
(7) Failure
or refusing to comply with or failing or refusing to maintain the
retail premises in accordance with the sanitary or health provisions
of the city.
(8) Possession
of any narcotic.
(9) Possession
of any equipment used or designed for the use of administering any
narcotic.
(10) Permitting any person to possess on the licensed premises any narcotic
or any instrument used for or designed for the use of administering
any narcotic.

It shall be unlawful for any person to sell or offer for sale
any liquor, mixed beverages, wine and beer except during the followings
days and hours:
(1) Hours
of operation for liquor stores:
(A) Monday–Saturday: 10:00 a.m. to 9:00 p.m.
(B) Closed on Sunday, Thanksgiving Day, Christmas Day and New Year’s
Day. If Christmas Day or New Year’s Day falls on a Sunday, closed
the following Monday.
(2) Hours
of sales for bars and restaurants:
(A) Monday–Friday: 7:00 a.m. to midnight.
(B) Saturday: 7:00 a.m. to 1:00 a.m.
(C) Sunday: 12:00 noon to 12:00 midnight (10:00 a.m. to 12:00 noon only
in conjunction with the food service to the customer).
(3) Hours
of alcohol sales for beer/wine off-premises consumption only (convenience
store/grocery store:
(A) Monday–Friday: 7:00 a.m. to midnight.
(B) Saturday: 7:00 a.m. to 1:00 a.m.
(C) Sunday: 12:00 noon to 12:00 midnight.

(a) A
person commits an offense if he consumes or possesses with intent
to consume an alcoholic beverage in a public place at any time on
Sunday between 1:15 a.m. and 12:00 noon and on any other day between
1:15 a.m. and 7:00 a.m.
(b) An
offense under this section is a misdemeanor punishable by a fine of
not less than ten dollars ($10.00) nor more than two hundred dollars
($200.00).

It shall be unlawful for any person to bring or carry into any
enclosure, field or stadium, where athletic events sponsored or participated
in by any public school are being held, any alcoholic beverage or
to have any alcoholic beverage in his possession while in or on such
enclosure, field, or stadium.

Whoever shall get drunk or be found in a state of intoxication
in any public place, or at any private house except his own, shall
be fined not less than ten dollars ($10.00) nor more than two hundred
dollars ($200.00).

It shall be unlawful for any person to consume any alcoholic
beverage while on city-owned streets or sidewalks.
