When used in this article, the following terms shall have the
following meanings:
BUILDING ACTIVITY
The construction, alteration, repair, movement, equipment,
removal, demolition, location, maintenance, of every building or structure.
GRADING/EXCAVATION
The use of powered equipment or explosives in the movement
of earth, rock or other material, and includes but is not limited
to anchoring, augering, backfilling, blasting, digging, ditching,
drilling, driving in, grading, plowing in, pulling in, ripping, scraping,
trenching, and tunneling; but shall not include such use in agricultural
operations nor operations which do not extend more than 24 inches
beneath the existing surface nor acts of political subdivisions performing
routing maintenance with the right-of-way of roads within their jurisdiction.
MINIMAL NOISE
Sounds that are normally audible in a residential neighborhood
during the time of occurrence. Examples of sounds that exceed minimal
noise include sounds from heavy vehicular equipment, hammering and
power tools used outdoors. For purposes of this standard, sound pressure
in excess of 65 decibels shall be considered to exceed minimal noise.
All building activity shall be permitted Monday through Saturday
between the hours of 7:00 a.m. and 7:00 p.m., prevailing time. Activity
on Sundays and in excess of the above-stated times will be limited
to activities causing minimal noise. It shall be unlawful for any
person, firm, corporation or association to conduct grading/excavation
on a Sunday or legal holiday without the approval of the Chartiers
Township Board of Supervisors or its designated representative. Grading
activity is permitted only between the hours of 7:00 a.m. and 7:00
p.m., Monday through Saturday, unless these time limits are extended,
excused or otherwise extended upon good cause shown or upon exigent
circumstances modified by the Chartiers Township Board of Supervisors.
The Chartiers Township Police Department and the Chartiers Township
Code Enforcement Officer shall be charged with the duty of enforcing
this article.
Any person, firm, corporation or association who or which violates
or permits a violation of this article shall, upon being found liable
therefor in a civil enforcement proceeding commenced by the Township
before a court of competent jurisdiction, pay a fine of not more than
$600, plus all court costs, including reasonable attorney's fees,
incurred by the Township in the enforcement of this article. If the
defendant neither pays nor timely appeals the judgment, the Township
may enforce the judgment pursuant to the applicable Rules of Civil
Procedure. Each day a violation exists shall constitute a separate
offense. Further, the appropriate officers or agents of the Township
are hereby authorized to seek equitable relief, including injunction,
to enforce compliance herewith.
