A. 
Employees on an annual salary basis, except for members of the Township Police Department, shall be granted the following annual leave for vacation purposes with pay:
(1) 
Less than one year of service: one day for each month of service.
(2) 
One year of service through the completion of five years of service: 12 days.
(3) 
After five years of service and up to 12 years of service: 15 days.
(4) 
After 12 years of service and up to 15 years of service: 17 days.
(5) 
After 15 years of service and up to 20 years of service: 20 days.
(6) 
After 20 years of service: 25 days.
B. 
Where in any calendar year, the vacation or any part thereof is not granted by reason of pressure of municipal business, such vacation periods or parts thereof not granted shall accumulate and shall be granted during the next succeeding calendar year only. Notwithstanding the foregoing, the department director under which the employees serve may, in his/her discretion, permit an employee to carry over vacation days beyond the next succeeding calendar year or pay an employee for any part of a vacation period in lieu thereof. In determining vacation leaves, the years of service of such employee prior and subsequent to the adoption of this subsection shall be used.
An employee who is a member of the National Guard or naval militia of this state or of the military or naval forces of the United States, required to undergo field training therein, shall be entitled to additional leave of absence with pay for the period of such field training.
In case of sickness, employees in the classified service and on a yearly salary basis of the Township of Nutley, New Jersey, shall, in addition to their annual vacation leave with pay, be granted sick leave as hereinafter defined, with pay, of not less than one working day for each month of service during the remainder of the first calendar year of service following permanent appointment and, in addition, 15 working days in each calendar year thereafter. If any such employee requires none or only a portion of such allowable sick leave for any calendar year, the amount of such leave not taken shall accumulate to his or her credit from year to year, and such employee shall be entitled to such accumulated sick leave of absence with pay if and when needed. In computing the accumulation of sick leave, the years of service of such employee prior and subsequent to the adoption of this article shall be used.

Any employee in the classified service who shall become temporarily unable, by reason of injury sustained in or sickness caused by the discharge of his or her duties, to perform his or her said duties shall be entitled to full pay for three months and half pay for a further period of three months, provided that a certificate is furnished, signed by the Township physician, certifying as to the cause of such employee's condition and that said employee is unable to perform his or her duties by reason thereof.
B. 
Any employee who shall receive temporary compensation or recover a judgment, award or decree for compensation under the Employer's Liability Act shall not be entitled to any pay as outlined in this section.
Employees are entitled to sick leave in accordance with the New Jersey Paid Sick Leave Law N.J.S.A. 34:11-56a. Sick leave is to be used in accordance with state law and in cases where the employee is ill and unable to work, or in cases of the serious illness of a family member. Employees absent on sick leave for five or more consecutive working days must submit a doctor's verification of illness or injury. If an employee is attending to an immediate family member, including civil union partner, a doctor's verification of that individual is required. After the 10th day of absence on sick leave in one calendar year, a doctor's verification must be submitted for all sick leave absences, regardless of duration. Prior to the return to work, the Township of Nutley may require an employee to be examined by a physician designated by the Township of Nutley to verify fitness to return to normal duties. An employee will not be permitted to return to work until the verification is received.

The Board of Commissioners may grant a leave of absence with pay to any member of its Police or Fire Department[1] who shall become injured, ill or disabled from any cause if evidenced by the certificate of a physician designated by the Board of Commissioners to examine him.

No such leave of absence with pay shall exceed one year commencing from the date of such injury, illness or disability.
A. 
Each employee of the Township of Nutley is hereby granted a bereavement leave of three calendar days off without loss of pay immediately following the death of the following members of the employee's immediate family: mother, father, sister, brother, spouse, child, domestic partner, grandparents and corresponding step relatives and in-laws. Bereavement leave of one day shall be granted upon the death of an aunt or uncle or corresponding in-law. Reasonable verification of the event may be required by the Township.
B. 
Bereavement leave, pursuant to this provision, shall commence with the day of death or the day of funeral, shall be calendar days and shall not be in addition to any holiday, day off or compensatory time falling within the period of bereavement.
The provisions of this article with respect to such leave shall also apply to employees on an annual salary basis.
Any salaried annual employee who works on a base of less than 40 hours a week shall be compensated at regular time through the forty-hour period and thereafter at time and a half for each hour worked over 40 hours.
