As used in this Part, the following terms shall have the meanings
indicated, unless a different meaning clearly appears from the context:
LICENSE
The written approval as issued by the Zoning Officer, authorizing
a person to operate and maintain a mobile home park under the provisions
of this Part.
MOBILE HOME
A transportable single-family dwelling intended for permanent
occupancy, contained in one unit, or in two or more units designed
to be joined into one integral unit capable of again being separated
for repeated towing, which arrives at a site complete and ready for
occupancy except for minor and incidental unpacking and assembly operations,
and constructed so that it may be used without a permanent foundation.
MOBILE HOME PARK
Any plot of ground which is leased or rented, and upon which
two or more mobile homes occupied for dwelling or sleeping purposes
are located.
MOBILE HOME LOT
A parcel of land in a mobile home park, improved with the
necessary utility connections and other appurtenances necessary for
the erection thereon of a single mobile home.
OWNER
Any individual, firm, trust, partnership, corporation, company,
association, or other legal entity which rents or leases spaces in
a mobile home park.
RECREATIONAL VEHICLE; TRAVEL TRAILER
A truck-mounted camper, an auto, truck, van or bus built
or, adapted for vacation living, a folding tent camper, and similar
devices used for temporary portable housing.
RECREATIONAL VEHICLE PARK
Any plot of ground which is leased or rented, upon which
two or more tents, camping trailers, travel trailers, pick-up coaches,
motor homes, or any combination thereof, occupied for dwelling or
sleeping purposes are located. Mobile homes are prohibited in recreational
vehicle parks.
SERVICE BUILDING
A structure which contains operational, office, recreational,
sanitary, maintenance, or other facilities built for the use of the
mobile home park residents or owner.
SEWER CONNECTION
All pipes, fittings and appurtenances from the drain outlet
of the mobile home to the inlet of the corresponding sewer riser pipes.
SEWER RISER PIPE
That portion of the sewer lateral which extends vertically
to the ground elevation and terminates at each mobile home lot.
WATER CONNECTION
All pipes, fittings and appurtenances from the water riser
pipe to the water inlet pipe of the distribution system within the
mobile home.
WATER RISER PIPE
That portion of the water service pipe which extends vertically
to the ground elevation and terminates at a designated point on each
mobile home lot.
WATER SERVICE PIPE
All pipes, fittings, valves and appurtenances from the water
main of the park distribution system to the water outlet of the distribution
system within the mobile home.

1. License
Required. It shall be unlawful for any person to maintain, construct,
alter or extend any mobile home/ recreational vehicle park within
the limits of the Township of Smithfield unless he holds a license
issued by the Zoning Officer in the name of such person for the specific
maintenance, construction, alteration, or extension proposed. The
Township license shall be conspicuously posted in the office or on
the premises of the park at all times.
2. Application
to Smithfield Township. The applicant shall also submit an application
to the Zoning Officer using a form furnished by the Township of Smithfield
for a license to operate a mobile home park in the Township of Smithfield.
3. Inspection
of Mobile Home/Recreational Vehicle Parks. The Zoning Officer may
inspect a mobile home/recreational vehicle park at reasonable intervals,
and at reasonable times, to determine compliance with this Part.
4. Compliance
of Existing Parks.
A. Parks
in existence as of the date of adoption of this Part may be continued
so long as they otherwise remain lawful.
B. Any subsequent new construction, alteration or extension of an existing park shall comply with the provisions of the Smithfield Township Subdivision and Zoning Ordinances (Chapters
22 and
27].
C. Any existing
park which, in the opinion of the Zoning Officer, creates a safety
hazard shall be required to comply with this Part within a reasonable
period of time as determined by the Smithfield Township Supervisors.
5. Individual Mobile Homes. Individual mobile homes permitted in areas as set forth in the Zoning Ordinance [Chapter
27] and not located in a mobile home park shall not be required to obtain zoning and building permits as prescribed by the Smithfield Township ordinances. Individual mobile-homes shall comply with all other applicable municipal ordinances and regulations governing single-family homes.
6. Inspection;
Revocation of License; Appeals. Whenever, upon inspection of any park,
it is determined that conditions or practices exist which are in violation
of any provision of this Part, or of any regulations adopted pursuant
hereto, the Zoning Officer shall give notice in wiring in accordance
with the provisions of this Part to the person to whom the license
was issued, advising him that unless such conditions or practices
are corrected within a reasonable period of time specified in the
notice, the license to operate in the Township of Smithfield shall
be suspended.
At the end of such period, such park shall be inspected and,
if such conditions or practices have not been corrected, the Zoning
Officer shall suspend the license and give notice in writing of such
suspension to the person to whom the license is issued. The licensee
or applicant may appeal the decision of the Zoning Officer by petitioning
for a hearing within 10 days of the decision. Within 30 days of the
petition the Smithfield Township Supervisors shall hold a hearing
and render its decision.

A schedule of fees for applications, licenses and/or inspections
shall be established by the Smithfield Township Supervisors pursuant
to resolution.

The storage, collection, and disposal of refuse in the in the
park shall be so managed as to not create health hazards, rodent harborages,
insect-breeding areas, accident or fire hazards or air pollution,
and shall be in accordance with Smithfield Township Ordinances.

Fire protection provisions shall be in accordance with the Smithfield
Township ordinances.

All piping from outside fuel storage tanks or cylinders to mobile
homes shall be copper or other acceptable metallic tubing and shall
be permanently installed and securely fastened in place. All fuel
storage tanks or cylinders shall be securely fastened in place and
shall not be located inside or beneath the mobile home or less than
five feet from any mobile home exit.

Whenever, upon inspection of any park, it is determined that conditions or practices exist which are in violation of any provision of this Part, or of any regulations adopted pursuant hereto, the Zoning Officer shall give notice in writing to the person to whom the license was issued, advising him that unless such conditions or practices are corrected within the period of time specified in the notice, the license to operate shall be suspended. At the end of such period such park shall be reinspected and, if such conditions or practices have not been corrected, the Zoning Officer shall suspend the license and give notice in writing of such suspension to the person to whom the license is issued. An aggrieved party may file an appeal to the Smithfield Township Supervisors in accordance with §
14-102, Subsection 7.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a district justice in the manner provided for the enforcement of summary
offenses under the Pennsylvania Rules of Criminal Procedure, shall
be sentenced to pay a fine of not more than $1,000 plus costs and,
in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each Section of this Part which shall be found to have been violated
shall constitute a separate offense.
