The purpose of the final plan review is to obtain formal approval by the Board of Supervisors for completed plans and to enter into necessary financial securities or a development agreement prior to recording and commencement of work. The plan shall conform substantially to the preliminary plan as approved, but, if desired by the applicant/developer, it may constitute only that portion of the approved preliminary plan which he proposes to record and develop at the time. The Board of Supervisors may require the applicant/developer to submit a total development plan for all portions of the plan and in such detail as required by the Board of Supervisors.

1. 
The applicant/developer shall make application to the Township Zoning Officer 10 days prior to the Planning Commission Meeting at which the plan is to be accepted for review; such application will include all plans, data and information listed below and in § 22-703:
A. 
The application shall be made on forms available at the Township building and shall be accompanied by a specified fee and deposit. Such fees shall include the reasonable and necessary charges for the Township Engineer and other professional consultants to review the plans, in accordance with a fee schedule set by resolution of the Board of Supervisors.
B. 
The applicant/developer shall submit nine sets of the final plans and data prepared in accordance with

The applicant/developer shall submit two electronic copies (one in Auto CAD format and one in PDF format) of the final plan on durable media such as CDs or DVDs.
D. 
Upon submission of a final plan, the Township shall determine if the application is complete and, if so, schedule it to be accepted for review at the next regularly scheduled Township Planning Commission Meeting; if the Township determines the application is incomplete, the plan and application shall not be reviewed but shall be returned to the applicant/developer with a report indicating the deficiencies. Once the plan is accepted for review by the Planning Commission this shall be considered the start of the MPC ninety-day review period.
E. 
Distribution. The Township shall distribute copies of the final plan and supporting data to the following:
(1) 
The Board of Supervisors: three copies.
(2) 
The Township Planning Commission: nine copies.
(3) 
The Environmental Advisory Committee: one copy.
(4) 
The Township files: one copy.
In addition to the copies noted above, the following submissions shall be made by the applicant/developer:
(1)
Township Engineer: one copy.
(2)
Township Solicitor: one copy.
(3)
Water Authority: copies per agency submission requirements.
(4)
Sewer Authority: copies per agency submission requirements.
(5)
PennDOT (where required): copies per agency submission requirements.
(6)
Monroe County Planning Commission: copies per agency submission requirements.
(7)
Monroe County Conservation District: copies per agency submission requirements.

1. 
The final plan shall show or be accompanied by the following information:
A. 
General Information. All information required of preliminary plans unless herein modified. All plans must be acknowledged and signed and sealed in accordance with the requirements of the Pennsylvania Engineer, Land Surveyor and Geologist Registration Law. If an environmental consultant, architect or landscape architect collaborated in the preparation of the plan, his/her name and address shall also appear. If the applicant/developer is a corporation, a raised corporate seal shall be provided.
B. 
Drafting Standards. Drafting standards shall be the same as those required for preliminary plans.
C. 
Compliance with Preliminary Plan Approval. All final plans shall address the conditions of preliminary plan approval.
D. 
Proof of submission to the all agencies, authorities, commissions, persons, etc., required to be distributed by the applicant/developer under the submission guidelines of this Part.
(1) 
Sewer Authority Reservation. Applicant/developer to provide fully executed reservation agreement.
(2) 
Water Authority. Applicant/developer to provide fully executed reservation agreement or similar approval.
E. 
Final Common Open Space (Greenway Land) Ownership and Management Plan. Using the final plan as a base map, the boundaries, acreage and proposed ownership of all common open space (Greenway land) shall be shown. A narrative report shall also be prepared indicating how and by whom such common open space (Greenway land) will be managed, and demonstrating the applicant/developer’s compliance with the Zoning Ordinance [Chapter 27].
All offers of dedication of realty or structures and all declarations, easements, and covenants governing the reservation and maintenance of undedicated common open space (Greenway land) shall be in a form acceptable to the Township.
A copy of the proposed deed restrictions, easements, covenants and declarations shall be submitted and shall be in a form acceptable to the Township.
F. 
Final conservation easements or deed restriction documents.
G. 
The Final Community Association Document. The final community association documents shall be consistent with the terms of the preliminary plan approval and modified as necessary to reflect the proposal for final approval.

1. 
Township Engineer Review.
A. 
The Township Engineer, following receipt of the plans from the Planning Commission, shall:
(1) 
Review the engineering considerations in the applicant/developer’s submission.
(2) 
Prepare a report for the Planning Commission and Board of Supervisors.
B. 
The Engineer shall review the engineering considerations and guarantees of the submissions and prepare a report of adequacy for the Planning Commission and Supervisors. The Township Engineer shall thoroughly check the final plans of all subdivision or land developments in order to determine the degree of compliance to all Township ordinances, design standards, engineering considerations and compliance with the conditions of preliminary plan approval. The Engineer’s review will be directed most specifically to plan content and completeness of drawings for construction contract purposes. The full intent of all design standards of the Township must be clearly defined in final plans. The final plans shall not be recommended for approval and shall not be signed by the Township Engineer until the applicant/developer has completed all plan requirements.
2. 
Planning Commission Review. Following receipt of the complete submission the Planning Commission shall:
A. 
Township, the Planning Commission shall:
(1) 
Receive and review the applicant/developer’s submission.
(2) 
Receive and review the report by the Monroe County Planning Commission and the reports of all other reviewing agencies or persons.
(3) 
Receive and review the report by the Township Engineer.
(4) 
Listen to applicant/developer’s presentation.
(5) 
Discuss submission with the applicant/developer at a Planning Commission meeting.
(6) 
Determine whether the final plans meet the requirements of this Chapter and the Township Zoning Ordinance [Chapter 27] and comply with all the conditions of preliminary plan approval. A final plan shall not be recommended for approval until the applicant/developer has met all the conditions of the action granting approval of such plan at the preliminary plan stage.
(7) 
Submit a recommendation regarding plan approval on the plan for use by the Board of Supervisors; such recommendation to be contained within the Commission’s regular minutes or as a separate report at the discretion of the Planning Commission.
3. 
Board of Supervisors Review.
A. 
Following receipt of the Township Planning Commission’s report and, unless extended by the applicant/developer, within 90 days following the date of the first regular Planning Commission meeting which follows the date the complete application is filed, the Board of Supervisors shall:
(1) 
Receive and review the applicant/developer’s submission, listen to the applicant/developer’s presentation and discuss the project with the applicant/developer at a public meeting.
(2) 
Receive and review the reports by the Township Planning Commission, the Township Engineer, the Monroe County Planning Commission and other agencies or officials who have submitted a report.
(3) 
Evaluate the applicant/developer’s submission, presentation, the discussion with the applicant/developer, the Township Engineer’s report and the Planning Commission’s report.
(4) 
Determine whether the final plan meets the objectives and requirements of this Chapter and the Township Zoning Ordinance [Chapter 27] and comply with all the conditions of preliminary plan approval. A final plan shall not be recommended for approval until the applicant/developer has met all the conditions of the action granting approval of such plan at the preliminary plan stage.
(5) 
Express its approval of the plan, stating the conditions of such approval, if any, or its disapproval, stating the reasons therefor. The Township may approve plans subject to conditions which require the consent of the applicant/developer, in which event the applicant/developer shall advise the Board of Supervisors prior to the final vote by the Board of Supervisors on the plan as to whether he accepts or rejects said conditions.
(6) 
Ruling on the Final Plan. The Board of Supervisors shall act upon the final plan within the time limits and in the manner required in the MPC.
(7) 
Notification of Ruling. The Board of Supervisors shall provide written notice to the applicant/developer in accordance with MPC requirements. Refusal by the applicant/developer to accept conditions of approval shall constitute disapproval of the plan.
B. 
A final plan shall not be signed by the authorized officers of the Board of Supervisors until the applicant/developer has met all of the conditions of the action granting approval of such plan.
4. 
Following approval of a final plan, the applicant/developer shall submit four completed and executed record plan Mylar drawings for signatures by the members of the Board of Supervisors. No Mylar plans shall be released for recording until a development agreement and related financial security between the Township and the applicant/developer have been executed.
5. 
No changes, erasures, modifications or revisions shall be made in any final plan after approval has been given by the Board of Supervisors and endorsed, in writing, on the plan. In the event that any final plan, when recorded, contains any such changes, the final plan shall be considered null and void, and the Board of Supervisors shall institute proceedings to have said plan stricken from the records of the County Recorder of Deeds.
6. 
All approved final plans must be recorded in accordance with Part 9, “Recording of Final Plan.”
