This article shall be known as the "Board of Attendance by Videoconference Local Law of 2022."
A new Chapter 25, Article I, shall be added to the Village of Webster Code, entitled "Board Meetings: Board Attendance by Videoconference."
As used in this article, the following terms shall have the meanings indicated:
EXTRAORDINARY CIRCUMSTANCES
Disability, illness, caregiving responsibilities, or any other significant and unexpected factor or event that precludes the member's physical attendance at such meeting.
The Village of Webster Board of Trustees authorizes its members, the members of the Village of Webster Zoning Board of Appeals, the members of the Village of Webster Historic Preservation Commission, and the Village of Webster Parks and Recreation Committee who experience an extraordinary circumstance, as defined in § 25-3 above and further defined by any rules or written procedures later adopted, to attend meetings by videoconference:
A. 
So long as a quorum of the members attend in person at one or more locations open to the public;
B. 
As long as the members can be seen, heard, and identified while the open portion of the meeting is being conducted; and
C. 
As otherwise permitted under § 103-a of the Public Officers Law (Open Meetings Law).
The Village of Webster Board of Trustees shall create written procedures further governing its use of videoconferencing by board members in compliance with Public Officers Law §103-a, Subdivision (2)(b).
This article shall take effect 20 days after it is filed in the office of the Secretary of State as provided in § 27 of the Municipal Home Rule Law.
