To permit the retail sale and dispensing of cannabis in areas
of the Town compatible with other commercial activity.
For the purposes of this article certain words and terms are
defined as follows:
CANNABIS DISPENSARY
An establishment used exclusively for the retail sale of
cannabis and as otherwise defined in the NYS Marihuana Regulation
and Taxation Law that is registered to operate in the State of New
York.
CANNABIS, RETAIL SALE
The solicitation or receipt of an order for, to keep or expose
for sale, and to keep with intent to sell, made by any licensed person,
whether principal, proprietor, agent, or employee, of any cannabis,
cannabis product, cannabinoid hemp or hemp extract product to a cannabis
consumer for any purpose other than resale.
DAY CARE
Any establishment licensed pursuant to NYS Social Service
Law § 390 as a program or facility caring for children for
more than three hours per day per child, where child day care is provided
by a childcare provider.
RELIGIOUS INSTITUTION
A building where persons regularly assemble for religious
worship and maintained and controlled by a religious body organized
to sustain public worship, together with all accessory buildings and
uses customarily associated with such primary purpose. For purposes
of this article the definition includes "church," "synagogue," "temple,"
"mosque," or other such place of worship and religious activity.
SCHOOL
A facility, whether public or private, furnishing a comprehensive
curriculum of academic instruction on the pre-kindergarten, kindergarten,
primary and/or secondary level.
Retail sale and retail dispensing of cannabis shall be permitted with an approved special use permit in the IC1 and C2 Zoning Districts as established in Article
II, Establishment of Uses, of Chapter
130, Zoning.
The following standards shall apply to all cannabis retail sales
and dispensary establishments.
A. Cannabis retail establishments and dispensaries shall not be located
within 500 feet of the boundary line of a property used as a school,
religious institution, public recreational facility or day care.
B. The distance provided in Subsection
A above shall be measured by following a straight line, without regard to intervening buildings, from the nearest point of the parcel lot line upon which the retail cannabis or cannabis dispensary use is to be located to the nearest point of the parcel lot line.
