In conformity with Section 5-1(a) of the Millbury Town Charter, there shall be established in the town of Millbury a department of public works. The department of public works shall consolidate the functions and operations of the cemetery, highway, parks and sewer departments, and shall assume the responsibility for the management and operations of the cemetery, highway, parks and sewer departments, under the direction of the town manager, in conformity with: (a) the policies and directives of the board of selectmen, acting in its capacity of the chief executive office of the municipality under Section 3-2(b) of the Millbury Town Charter; (b) the policies and directives of the boards of cemetery commissioners, parks commissioners, and sewer commissioners; (c) the enabling and special legislation establishing and managing the Millbury sewer department and sewer enterprise fund; and (d) all applicable laws, rules, regulations, and local bylaws.

A director of public works shall be the administrative head of the department of public works. The town manager shall appoint a director of public works to a term of up to three years, in conformity with the provisions of Sections 4-2(b) and 8-5(e) of the Millbury Town Charter.
The director of public works shall be selected on the basis of merit and qualifications, and have a bachelor's degree in civil engineering or other appropriate discipline, and preferably be registered as a professional civil engineer, and possess relevant professional experience in public works, construction and management.
The director of public works shall be appointed for a term of up to three years, and may be removed from office by the town manager for cause after a public hearing. The director of public works shall perform the duties and assume the responsibilities of the highway superintendent (highway surveyor) and the superintendent of sewers, under the direction and supervision of the town manager in conformity with the policies of the board of selectmen, as well as the policies and directives of the boards of cemetery commissioners, parks commissioners and sewer commissioners.
The director of public works shall work under the terms and conditions of an employment contract, said contract to have a duration with the same commencement and ending date as the term of appointment, and shall authorize not only the terms, conditions and responsibilities of employment for the director of public works, but shall also establish the level of compensation and fringe benefits for the director of public works, subject to the availability of funds, in conformity with the provisions of Section 4-2(k) of the Millbury Town Charter.
