A. Any
obstruction of the flow of water in, on, across, through or over any
watercourse, arroyo, tributary, or flood drainage channel is prohibited.
It is unlawful for any person to obstruct any channel of the natural
flow of water or floodwater within the corporate limits of the town
unless constructing a new diversion watercourse engineered and/or
approved by the town.
B. Any
violation of this section shall be a misdemeanor. Property owners
who have been provided with a notice of violation of this section
by the town shall remove the obstruction within thirty (30) calendar
days. If the obstruction is not removed by the property owner within
this period, the town may contract to have the obstruction removed
and charge the costs to the property owner. Failure by the owner to
pay the charges within thirty (30) days will result in a lien placed
on the property.
C. The
impeding of the flow of water over, through, in, on or across said
watercourses, arroyos, tributaries, for flood drainage channels is
considered to be a nuisance and subject to injunction as such.
