As used in this article, the following terms shall have the meanings respectively ascribed to them, unless the context clearly indicates a different meaning:
ATTENDANT
A direct-hire or contract employee of Waste Management of Virginia, Inc., who is charged with the supervision of disposal activities at a convenience center or sanitary landfill.
BOARD OR BOARD OF SUPERVISORS
The Board of Supervisors of the County.
COMMERCIAL WASTE
All solid waste generated by establishments engaged in business operations other than manufacturing or construction. This category includes, but is not limited to, solid waste resulting from the operation of stores, markets, office buildings, restaurants, and shopping centers.
CONVENIENCE CENTER
A location where solid waste and recyclable materials are placed and stored in bulk containers awaiting transfer to a landfill or recycling facility.
COUNTY
Amelia County, Virginia.
DEQ
The Virginia Department of Environmental Quality and any successor thereto.
DISPOSAL
The discharge, deposit, injection, dumping, spilling, leaking, or placing of any solid waste into or on any land or water so that such solid waste or any constituent of it may enter the environment or be emitted into the air or discharged into any waters.
HAZARDOUS WASTE
A waste with properties that make it dangerous or capable of having a harmful effect on human health or the environment.
HOUSEHOLD WASTE
Any waste material, including garbage, trash, and refuse, derived from households.
INDUSTRIAL WASTE
A solid waste generated by manufacturing or industrial process that is not a regulated hazardous waste.
INSTITUTIONAL WASTE
All solid waste emanating from institutions such as, but not limited to, nursing homes and public and private schools.
LITTER
The highly visible portion of solid waste (usually packaging material) which is generated by the consumer and carelessly discarded outside of the regular garbage disposal system, as on the highways or in streets.
MAPLEWOOD LANDFILL
The commercial sanitary landfill located at 20221 Maplewood Road, Jetersville, Virginia, and operated by Waste Management of Virginia, Inc.
OPEN DUMP
A site on which any solid waste is placed, discharged, deposited, injected, dumped, or spilled so as to present a threat of release of harmful substances into the environment or present a hazard to human health.
PERSON
An individual, corporation, partnership, association, a governmental body, a municipal corporation, or any other legal entity.
PRIVATE PROPERTY
Property owned by a person as defined herein, not including any government or governmental entity, including but not limited to yards, grounds, driveways, entrance or passageways, parking areas, storage areas, any body of water, vacant land, and recreation facilities.
PUBLIC PROPERTY
Any area that is used or held out for use by the public, whether owned or operated by public or private interests, including but not limited to highways, streets, alleys, parks, recreation areas, sidewalks, medians, lakes, rivers, streams, ponds or other bodies of water.
RECYCLING
The process of separating a given waste material from the waste stream and reprocessing it so that it is used again as a new material for a product, which may or may not be similar to the original product.
RESIDENTIAL WASTE
Solid wastes derived from normal residential activities at a household.
SANITARY LANDFILL
An engineered land burial facility for the disposal of household waste that is located, designed, constructed, and operated to contain and isolate the waste so that it does not pose a substantial present or potential hazard to human health or the environment. A sanitary landfill also may receive other types of solid wastes, such as commercial solid waste, nonhazardous sludge, construction demolition debris, and nonhazardous industrial solid waste.
SOLID WASTE
Any garbage, refuse, rubbish, litter or ashes and other discarded materials, resulting from household, industrial, commercial, mining, and agricultural operations, and from community activities.
VEHICLE
Every device capable of being moved upon a public highway or public waterway and in, upon or by which any person or property may be transported or drawn upon a public highway or public waterway.
A. 
It shall be unlawful for any person to drop, deposit, discard, or otherwise dispose of any solid waste or litter in, upon or beneath any public or private property in the County of Amelia including but not restricted to any street, sidewalk, park, body of water, well, spring, reservoir, watercourse, vacant or occupied lot other than a convenience center, sanitary landfill or other authorized receptacles or locations designated by the County for such purpose and then only in the manner provided by the article and by the governmental regulations relating thereto.
B. 
It shall be unlawful for any person to permit any land within the County which is owned or occupied by him or which is under his charge or supervision to be used as an open dump. Sanitary landfills and convenience centers are the only authorized places for disposal of solid waste in the County.
A. 
It shall be unlawful for any person transporting any wastes detailed in this article, whether liquid or solid, in any vehicle or upon or over any public street or right-of-way within the County, to fail to suitably contain said waste matter from spilling from the vehicle in which it is being transported.
B. 
No vehicle shall be driven or moved on any highway unless such vehicle is constructed or loaded to prevent any of its load from dropping, sifting, leaking, blowing or otherwise escaping therefrom.
C. 
No vehicle used to transport litter or other items likely to fall or be blown from such vehicle shall be driven or moved, stopped or parked on any highway unless such vehicle is covered to prevent its contents from blowing, dropping or falling from such vehicle.
D. 
Any person operating a vehicle from which any glass or objects have fallen or escaped, which could cause an obstruction or damage a vehicle or otherwise endanger travelers on such public property, shall immediately cause the public property to be cleaned of all glass or objects and shall pay any costs therefor.
A. 
Institutions, businesses, and industries may keep on their premises private waste collection bins or bulk containers for temporary storage of solid waste until such solid waste is disposed of in accordance with this article and other applicable law.
B. 
Large bulky items too large for any containers shall be carried directly to an appropriate site for disposal in accordance with this article and other applicable law.
C. 
It shall be the duty of each proprietor and each operator of any business, industry, or institution to keep the adjacent and surrounding area clear and free of litter. These areas include, but are not restricted to, public and private sidewalks, roads and alleys; grounds; parking lots; loading and unloading areas; and all vacant lots which are owned or leased by said business, industry or institution.
A. 
It shall be unlawful for any person to ship to, deposit upon or deposit within the premises of any sanitary landfill within the County any of the following:
(1) 
Hazardous wastes as identified by the U.S. Environmental Protection Agency under authority of the Resource Conservation and Recovery Act or DEQ's hazardous waste Management Regulations, as amended.
(2) 
Any infectious waste or radioactive waste, as such terms are defined by federal and state statutes and regulations.
(3) 
Any material which is toxic, pathological, highly flammable, explosive or otherwise determined to be dangerous.
(4) 
Any materials the disposal of which in the landfill would violate applicable federal or state laws, rules, regulations or permits.
(5) 
Any nuclear or nuclear by-product materials as defined by the Atomic Energy Act of 1954, as amended (86 Stat. 923).[1]

(6) 
Any material number of animal carcasses disposed of in a single day without specific written approval from the County.
(7) 
Any waste which in the opinion of the landfill operator and the County is not compatible with the landfill design or operation, and which could pose a threat to the safety of personnel or users of the landfill or which is not permitted for disposal in the landfill according to any of the federal, state or local permits governing the operation of the landfill.
B. 
All persons having solid waste unacceptable for deposit at any sanitary landfill within the County shall dispose of such waste in accordance with applicable law.
All convenience centers operated by the County or co-operated with or by authorized contractors of the County are for the use and benefit for Amelia County residents, and property owners, and are for the deposit of residential-household waste generated in the County of Amelia only. All deposits of solid waste at convenience centers shall conform to the following provisions:
A. 
No liquid waste of any kind shall be deposited at any convenience center.
B. 
No hazardous waste shall be deposited at any convenience center.
C. 
No industrial waste or commercial waste shall be deposited at any convenience center.
D. 
All solid waste transported to any convenience center shall be placed within the collection containers or recycle bins and no solid waste shall be placed in any collection container so that trash overflows onto the ground.
E. 
No solid waste or liquid waste of any kind shall be deposited on the ground at any convenience center.
F. 
No tires or dead animals shall be deposited in or at any convenience center. These items shall be taken directly to a sanitary landfill in the County or otherwise disposed of in accordance with applicable law.
G. 
No building materials of any type shall be placed in or at any convenience center.
H. 
No stoves, washing machines, refrigerators or other major appliances, bedsprings, mattresses, furniture, motor vehicles, or any other large bulky items shall be deposited in or at any convenience center. These items shall be serviced for Freon removal in accordance with applicable law, if required, and then disposed of at a sanitary landfill or otherwise disposed of in accordance with applicable law.
I. 
No person not a property owner or resident of the County of Amelia shall deposit any solid waste or litter in any convenience center.
J. 
No solid waste shall be deposited in containers designated for specific materials recycling except those items specifically noted on said containers.
It shall be unlawful for any unauthorized person to remove or cause to be removed any solid waste or recyclable material which has been properly deposited in or at a convenience center.
No person shall enter upon or remain within the premises of a sanitary landfill at any time while such landfill is closed to the public except by the authority of the applicable landfill manager, or his designee.
All persons using a sanitary landfill or convenience center shall obey the lawful orders or directives of the attendant or landfill representative in charge thereof.
Violations of this article shall be subject to a civil penalty, not to exceed $50 for the first violation. The civil penalty for subsequent violations within 12 months of the first violation shall not exceed $200. These penalties are in lieu of criminal penalties and preclude prosecution of such violation as a misdemeanor.
