The Township Supervisors may construct sidewalks or curbs or suitable material along the roads or highways in the Township of Patton pursuant to this chapter authorizing said construction.

Except in such instances when petitions are presented to the Board of Supervisors, signed by owners of property, representing a majority in number of feet the front of the properties abutting on roads or highways, all such sidewalks and sidewalks and curbs are to be constructed in accordance with the Second Class Township Code, Article XXIV, Section 2401, 53 P.S. § 67401.

The cost of said sidewalks or curbs, or sidewalks and curbs shall be paid by the abutting property owners in proportion to their frontage, but in no instance shall any abutting property owner be liable for the construction of such sidewalks in an amount greater than 10%, nor for the construction of such curbing in an amount greater than 10% of the assessed valuation of the abutting property owned by them, in accordance with the Second Class Township Code, Article XXIV, Section 2401, 53 P.S. § 67401. Any expense above such maximum liability of the abutting property owners shall be paid by the Township of Patton.
If any owner or owners of property against which an assessment shall have been made shall refuse or neglect to pay such an assessment within 60 days after service of the assessment bill has been made, the Supervisors of Patton Township, within the time permitted by law, shall file a municipal claim or lien therefor, together with interest at the rate of 6% per annum for the date of completion of the improvement contemplated. All unpaid assessments shall be certified to the Solicitor and said Solicitor shall file municipal claims or liens therefor in the proper office of Centre County, Pennsylvania, as provided by law against the property or shall have been charged. Such Solicitor thereupon shall proceed to collect all assessments under general laws relating to the collection of municipal liens in accordance with the Act of 1947, July 10, P.L. 1481, Section 17, as amended.[1]

A. 
General.
(1) 
It is the general policy of the Township to require sidewalks along both sides of public streets to provide for the safe movement of pedestrians. Thus, sidewalks are to be constructed in all zoning districts in the Township, except the following:

R-1 Rural Residential
NR-1 Natural Resources
FP-1 Floodplain
UD University District
A-1 Rural
(2) 
These areas are viewed as not typically generating enough pedestrian movement to warrant sidewalks. However, if circumstances arise which, in the opinion of the Board of Supervisors, will generate pedestrian traffic in these areas, the Board can require sidewalks to be constructed therein.
(3) 
Any rezoning of an area to a more intensive development zone will require sidewalks to be constructed along public streets in that zone. The cost of the sidewalks will be borne by the initiator of the rezoning request unless an alternative arrangement is deemed acceptable by the Board of Supervisors.
B. 
Materials and methods.
(1) 
Unless otherwise approved by the Board of Supervisors, all sidewalks shall be constructed in accordance with Section 676 of PennDOT Publication 408, 1987 Edition, with the exception that a four-inch stone base can be provided instead of a six-inch stone base. The construction material shall be air-entrained cement concrete, the width of the sidewalk shall be five feet, and the thickness of concrete no less than four inches. A cross-slope of 1/8 inch per foot shall be provided to direct runoff toward the street.
(2) 
Bituminous sidewalks may be approved by the Board of Supervisors only after presentation of substantial noneconomic based information supporting their use instead of cement concrete. If permitted, bituminous sidewalks shall be constructed of four inches of compacted ID-2 material on a four-inch stone base, and shall be five feet wide.
