A. 
License, Bond Required: Any person, except a gas utility company authorized by Montana Public Service Commission engaged in the business of installing, maintaining or repairing gas piping, equipment or appliances, shall first apply to the City Clerk-Treasurer for a license to engage in such business and shall pay to the City Clerk-Treasurer the sum of $75 as an annual fee. Such license shall be renewed annually. The license shall be issued on a calendar year basis. Prior to issuance of such business license, the applicant shall file, and thereafter keep on file, in the office of the City Clerk-Treasurer, a surety bond, to be effective during the period for which the license is issued, plus one year from the date of the expiration of the license; executed by a surety company duly authorized to do business in the State and running to the City, in the sum of $3,000, conditioned to the effect that such person shall perform all work in connection with the installation, maintenance and repair of gas piping, equipment and appliances in a skillful and workmanlike manner, using only suitable and proper materials, equipment and appliances, and that the licensee shall fully comply with all provisions of this chapter and that any person injured by failure of the licensee to comply with the provisions of this chapter shall have the right of action against the licensee and his or her surety in his or her name; provided, that any person desiring to avail him or herself of the benefits of such bond shall commence action thereon within one year after the date of the completion of the work alleged to have been done improperly. In addition to the aforementioned surety bond, the applicant shall file, and thereafter keep on file in the office of the City Clerk-Treasurer, the following proof that he or she has in full force and effect, with an insurance company satisfactory to the City.

Bodily injury liability insurance with minimum limits of $25,000 for each person injured by reason of the work for which the license was issued and minimum limits of $100,000 for each occurrence.
2. 
Property damage liability insurance with minimum limits of $25,000 for each accident and $100,000 aggregate.
B. 
Gas Fitters; License Required: Any person, except gas utilities engaged in the business of installing, maintaining or repairing gas piping, equipment or appliances is required to have a gas fitter's license for each member of the firm and each employee engaged in the actual installation, maintenance or repair of gas piping, equipment or appliances as hereinafter provided.
C. 
Compliance Required: No person shall install gas piping, equipment or appliances, unless and until, such person has first complied with all license requirements as hereinbefore set forth.

It shall be unlawful for any natural gas utility to operate within the corporate limits of the City until such utility shall have applied to the City Clerk-Treasurer for a license therefor and such officer shall have issued such license, for which there shall be paid a fee of $150. Such license shall be effective until January 1st of the following year, when it must be renewed.

No person shall install, extend, alter or repair any gas piping, equipment or appliance on a consumer's premises within the City limits unless such person has first applied in writing for, and procured, a gas fitters license therefor in accordance with the provisions of this chapter. Provided, however, that any employee of a gas utility or any plumber licensed by the State shall not be required to have a gas fitters license.

A. 
Fee: The annual fee for a gas fitters license shall be $5 for the first year and the renewal fee shall be $3 per year.
B. 
Renewal: Gas fitters licenses shall be renewed on or before January 15th of each year.
C. 
Term: Such license shall continue in force during the calendar year and expire on December 31st of the year in which it is issued unless revoked or suspended during the calendar year.

No person shall lend his or her gas fitters license to any other person, nor shall any such licensed person apply for a license in his or her name for use by any other person, and any such licensed person so doing or refusing to comply with any other requirements of this chapter shall have his or her gas fitters license suspended or revoked by the City.

Every licensed gas fitter shall display his or her current license certificate conspicuously at his or her principal place of business or employment.

A. 
Authority; Order: Any license granted under the provisions of this chapter may be suspended or revoked by the Building Official whenever it shall be made to appear to him or her that the person to whom the license is issued has violated any of the provisions of this chapter. In the event the Building Official shall suspend or revoke such license, he or she shall cause to be served on the licensee a formal order of suspension or revocation of the license, which order shall recite the reasons therefor.
B. 
Appeal: Any such suspension or revocation may be appealed by the licensee to the Kalispell Board of Appeals as provided in the Uniform Building Code.
