For purposes of this article, the following definitions shall
apply unless the context clearly indicates or requires a different
meaning.
"Camper"
means a structure designed to be mounted upon a motor vehicle
and to provide facilities for human habitation or camping purposes.
"Day"
means that period of time from 12:00 midnight to 11:59 p.m.
as it refers to days of the week.
"Loading and unloading"
means actively moving items to or from an oversized vehicle
including the activities required to prepare the vehicle for travel
or storage.
"Motorized vehicle"
means buses, motor trucks, house cars, pickup trucks with
campers, recreational vehicles or other self-propelled vehicles.
"Nonmotorized vehicle"
means any trailer or any other device that is not self-propelled
including camp trailer, semitrailer, or trailer coach as defined by
the California
Vehicle Code.
"Out-of-town visitor"
means any person who does not reside in the City of Redondo
Beach, who is temporarily visiting as a guest of a resident of the
City, and who has applied for an oversized vehicle overnight parking
permit.
Oversized vehicle.
For the purposes of this article, the phrase "oversized vehicle"
means any motorized vehicle as defined by Section 670 of the Vehicle
Code or combination of motorized vehicles and nonmotorized vehicles
or trailers that meets or exceeds twenty-two (22') feet in length
at any time or a combination of the two following criteria, exclusive
of fixtures, accessories or property: eight (8') feet in height and
seven (7') feet in width.
(1)
To determine the height, width or length of the vehicles defined
in this section, any extension to the vehicle caused by mirrors, air
conditioners, or similar attachments as allowed by Section 35109,
35110 or 35111 Of the
Vehicle Code as may be amended shall not be
included.
(2)
Oversized vehicle does not include pickup trucks or sport utility
vehicles, which are less than twenty-five (25') feet in length and
eight (8') feet in height.
(3)
Oversized vehicle does not include a commercial vehicle as defined in RBMC Section
3-7.901.
"Recreational vehicle"
means a vehicle or trailer which is capable of human habitation
or designed or used for recreational camping or travel use, whether
self-propelled or mounted on or drawn by another vehicle, or any structure
inspected, approved and designated a recreational vehicle by and bearing
the insignia of the State of California or any other State or Federal
agency having the authority to approve recreational vehicles. ""Recreational
vehicle" includes, without limitation, any of the following: (1) camp
trailer, as defined by California
Vehicle Code Section 242; (2) fifth
wheel travel trailer, as defined by California
Vehicle Code Section
324; (3) house car, as defined by California
Vehicle Code Section
362; (4) trailer coach, as defined by California
Vehicle Code Section
635; (5) mobile home, as defined by California
Vehicle Code Section
396; (6) boat, watercraft, and/or a trailer for a boat or watercraft;
(7) trailers designed to carry persons, property or animals on its
own structure and to be drawn by a motor vehicle; and (8) recreational
vehicle, as defined by California
Health and Safety Code Section 18010.
"Resident"
means a person who customarily resides and maintains a place
of abode or who owns landwithin the City of Redondo Beach. It shall
not mean a person who maintains an address at a post office box, mailbox
drop, or who rents a room without it being the primary place of abode.
"Trailer"
means a trailer, semitrailer, utility trailer, camp trailer
including tent trailers, boat trailers, unmounted camper or trailer
coach as defined in Sections 242, 243, 550, 630, 635, and 636 of the
California
Vehicle Code, or fifthwheel travel trailer as defined in
Section 324 of the
Vehicle Code.
"Utility trailer"
means a nonmotorized vehicle designed to carry persons, property,
animals, waste, materials, or any other items on its own structure
and to be drawn by another motor vehicle which is not designed for
recreational purposes.

No person shall stop, stand, park or leave standing any oversized
vehicle on any public highway, street or city parking lot at any time
between the hours of 2:00 a.m. and 6:00 a.m. unless otherwise authorized
by this article.

(a) The
prohibitions in this article will apply at all times, or at those
times specified, except when it is necessary to stop a vehicle to
avoid conflict with other traffic or to comply with the directions
of a police officer or an official traffic control device.
(b) The
time limitations on standing or parking in this article will not relieve
any person from the duty to observe other and more restrictive provisions
of the California
Vehicle Code or this Code prohibiting or limiting
the standing or parking of vehicles in specified places or at specified
times.

No person shall permit or cause any electrical, water, gas,
telephone or other utility connection to encroach into any public
right-of-way including across or above any street or sidewalk such
as electrical cords, extension cords, hoses, cables, or other items
from a residential or commercial property to an oversized vehicle
or trailer parked on a public highway or street. (A violation of this
section is an infraction/misdemeanor.)

The provisions of Section
3-7.2102 shall not apply to any of the following:
(a) Oversized
vehicles owned by a resident or out-of-town visitor displaying a permit
for overnight parking issued by the City Manager or designee in accordance
with this article. The issuance of a permit shall not allow any other
activity otherwise prohibited by law;
(b) Oversized vehicles owned by a resident or out-of-town visitor (as defined in Section
3-7.2101) parked on any public highway or street on Saturday, Sunday, Monday or a national holiday and that complies with the overnight permit parking conditions in accordance with Section
3-7.2106 of this article. The weekend exemption for an out-of-town visitor shall be in conjunction with an issued permit;
(c) Oversized
vehicles displaying a permit that belongs to out-of-town visitors
of a resident of the City. An out-of-town visitor permit shall be
valid for a maximum period of seven days and will not be issued to
a vehicle registered to a residence or address in the City;
(d) Oversized
vehicles involved in an emergency or being repaired under emergency
conditions. Emergency parking may be allowed for 24 consecutive hours
where a vehicle is left standing at the roadside because of mechanical
breakdown or because of the driver's physical incapacity to proceed.
Nothing herein shall be construed to permit a violation of any restriction
on vehicle repair elsewhere in the Redondo Beach Municipal Code;
(e) Oversized
vehicles belonging to Federal, State or local authorities or public
utilities that are temporarily parked while the operator of the vehicle
is conducting official business;
(f) Oversized
vehicles, not owned by a resident or out-of-town visitor, actively
engaged in the loading and unloading and deliveries of persons, merchandise,
wares, supplies, goods or other materials in the course of construction
or other work from or to any adjacent building or structure;
(g) Buses
when loading or unloading passengers at established zones;
(h) The
prohibitions provided in this article shall not apply to the parking
of any oversized vehicle during the pendency of any state of emergency
declared to exist within the City of Redondo Beach by the City Council;
(i) When
the City Council has determined by resolution that the parking of
oversized vehicles on certain streets shall be permitted.

Any resident within the City may obtain an oversized vehicle
overnight parking permit to park an oversized vehicle registered to
them adjacent to his or her residence or land owned as defined in
this article. Any resident may obtain an oversized vehicle overnight
parking permit to park an oversized vehicle belonging to an out-of-town
visitor that is a guest. Oversized vehicle overnight parking permits
give the resident owners of oversized vehicles and trailers the opportunity,
for a limited time, to park their oversized vehicle or trailer on
a public highway or street. The City Manager, or representative, may
issue a permit for overnight parking of an oversized vehicle to any
resident or owner of land within the City subject to the following
provisions:
(a) The
oversized vehicle shall be owned, leased, or rented by, or registered
to, a resident or an owner of land in the City of Redondo Beach;
(b) The
oversized vehicle shall park at the street curb immediately adjacent
to the residence or land owned, or within 400 feet of that person's
residence or land owned if this area is not available for parking
due to curb configuration or codified parking restrictions;
(c) The
oversized vehicle of a resident, owner of land or out-of-town visitor
that is issued an oversized vehicle overnight parking permit shall
park within 400 feet of the permit applicant's residence or land owned,
or it will be subject to citation, towing, or both;
(d) The
oversized vehicle overnight parking permit shall be prominently displayed
in the lower driver's side of the windshield or the nearest window
of the vehicle. The permit shall be clearly visible from the exterior
of the oversized vehicle and shall not cover the vehicle identification
number. Trailers shall display the oversized vehicle permits on the
side of the trailer so that the permit is visible from the street,
which is usually the left side of the vehicle;
(e) The
oversized vehicle shall not be used for camping, lodging, residing
or for accommodation purposes. Nothing in this article shall be construed
to permit sleeping or camping in a vehicle as prohibited by the Redondo
Beach Municipal Code;
(f) All
oversized vehicle permit holders shall comply with the City of Redondo
Beach street sweeping parking regulations and preferential parking
zone regulations pursuant to the Redondo Beach Municipal Code;
(g) An
oversized vehicle overnight parking permit shall not guarantee or
reserve to the holder an on-street parking space;
(h) An
oversized vehicle overnight parking permit shall not be issued to
a location that constitutes a hazard to vehicular traffic, prevents
the enforcement of the law by the Police Department, or that would
unreasonably restrict access of the Fire Department. The City Traffic
Engineer may deny or revoke an oversized vehicle overnight parking
permit if, upon a review of the location where the oversized vehicle
will be parked, the Traffic Engineer determines that this would create
a traffic hazard or otherwise would adversely affect public safety,
traffic flow or access.

(a) Each
resident oversized vehicle overnight parking permit shall be valid
for one day.
(b) Each
oversized vehicle overnight parking permit issued to an out-of-town
visitor shall be valid for a maximum of seven days including Saturday
and Sunday.
(c) No
more than three out-of-town visitor permits shall be issued to a residence/land
owned in a calendar year. The issuance of the seven day permit does
not relieve any person from the duty to observe other and more restrictive
provisions of the California
Vehicle Code or this Code prohibiting
or limiting the standing or parking of vehicles in specified places
or at specified times.
(d) Oversized
vehicle overnight parking permits for residents shall be valid for
a period not to exceed three consecutive weekdays (72 hours). If a
permitted oversized vehicle has been lawfully parked for the maximum
period of 72 consecutive hours, the oversized vehicle must be absent
from the location for a minimum of 24 hours from the expiration of
the permits to be lawfully parked overnight at the location again.
(e) No
person, residence, or designated oversized vehicle shall receive more
than six oversized vehicle overnight parking permits per month and
no more than 60 permits in any calendar year.
(f) Oversized
vehicle handicap parking permits shall be valid for a period of the
calendar year as long as the holder meets the requirements of the
section related to these permits. These permits may be renewed annually
in January.

(a) The
City Manager or representative may issue an oversized vehicle handicap
parking permit to a resident. An oversized vehicle handicap parking
permit shall allow the resident to park directly in front of (or the
side of the property if it is a corner lot) their residence without
overnight parking restrictions.
(b) In
order to be eligible to receive an oversized vehicle handicap parking
permit, the resident shall meet the following requirements:
(1) The applicant shall be entitled to receive a handicapped placard
or license plate pursuant to the provisions of the California Vehicle
Code;
(2) The handicapped placard may not be a temporary handicapped placard;
(3) The oversized vehicle is the only vehicle owned by the resident,
is the sole source of vehicular transportation for that resident and
is required to meet the daily transportation needs of the resident;
(4) Only one oversized vehicle per disabled person is exempt as the sole
source of transportation for that person;
(5) The permittee of an oversized vehicle handicap parking permit shall
notify the City Manager or representative within 72 hours when the
vehicle is no longer the sole vehicle driven by the resident or when
the vehicle is no longer required to meet the daily transportation
needs of the resident;
(6) The exception provided an oversized vehicle handicap parking permittee
for overnight parking will not relieve any person from the duty to
observe other and more restrictive provisions of the California Vehicle
Code or this Code prohibiting or limiting the standing or parking
of vehicles in specified places or at specified times.

The applicant for an oversized vehicle nighttime parking permit
shall provide such information as the City Manager or representative
determines necessary to effect the provisions of this article, including,
but not limited to:
(a) The
resident permit applicant's name, address of the residence or address
of the land owned, and telephone number;
(b) The
proposed parking location of the oversized vehicle;
(c) The
license plate numbers, makes, models and types of vehicles of the
oversized vehicles or combinations of vehicles;
(d) The
requested dates and time periods for the permit to commence in all
cases at 12:00 a.m. and end at 11:59 p.m. the following day;
(e) Proof
of the applicant's ownership, lease, or rental papers or the California
Department of Motor Vehicles registration for the oversized vehicle
or trailer if it cannot be verified to the applicant, does not show
that the vehicle is registered in the City, or cannot be verified
by the registration from an equivalent out-of-State agency;
(f) Proof
and status of the applicant as a resident or property owner of the
specific property identified for the permit. Acceptable proof of residency
must be current and must include a California driver license or California
identification card with an address that is not a post office box
or mailbox drop and one of the following: a property tax bill or public
utility bill (telephone bills are not acceptable);
(g) Such
other information as is determined by the City Manager or representative
to sufficiently identify residency, the permitted oversized vehicle,
and the dates and times requested.

Any fees for an oversized vehicle overnight parking permit shall
be established by resolution of the City Council and included in the
schedule of fees established by the annual fiscal year budget.

(a) Oversized
vehicles parked in violation of this article may be cited immediately
pursuant to the provisions of this article and fined for each violation.
(1) A violation of this article for the parking or standing of any oversized
vehicle on a highway, street or city parking lot shall be subject
to a civil penalty as established in the schedule of fees adopted
by a resolution of the City Council.
(2) Each day a violation is committed shall be considered a separate
offense subject to the issuance of a separate citation.
(b) Every
person who is issued a notice of parking violation pursuant to this
article may request review of that notice under Section 40215 et seq.,
of the California
Vehicle Code.
(c) Oversized
vehicles parked or left standing on a public highway, street, or in
violation of this article may be removed immediately pursuant to Vehicle
Code Section 22651.

(a) Every
person who displays a fraudulent, forged, altered, or counterfeit
oversized vehicle parking permit or permit number with the intent
to avoid compliance with this article is guilty of a misdemeanor.
(b) Every
person who forges, alters, or counterfeits an oversized vehicle parking
permit or an oversized vehicle handicap parking permit is guilty of
a misdemeanor.

The City may deny the issuance of an oversized vehicle overnight
parking permit for up to one year if the City Manager or representative
finds that any of the following conditions exist:
(a) If
the applicant or the person the applicant is visiting is not a bona
fide City resident or owner of land;
(b) If
the resident or out-of-town visitor guests of a resident have been
issued four or more citations in the same calendar year for parking
greater than 400 feet from the designated residence or land owned
address;
(c) If
the out-of-town visitor is not a guest of the resident/land owner
applicant;
(d) If
an owner of an oversized vehicle has procured any oversized vehicle
parking permit through fraud or misrepresentation, for example, the
information submitted by the applicant is materially false.

Any vehicle that is prohibited by size, weight or by type of
vehicle from parking overnight on any public street or highway as
specified by any section of this article, shall be prohibited from
parking overnight in a City parking lot, unless authorization has
been granted by the City Manager or representative to allow such vehicle
to park in the City parking lot on a temporary basis for a specified
purpose.

Pursuant to
Vehicle Code Section 22507, signs giving adequate
notice of the prohibitions contained in this section shall be posted
at the City limits of the City of Redondo Beach.
