In the construction of this code and of all ordinances of the
city, the following rules shall be observed, unless such construction
would be inconsistent with the manifest intent of the city council
or the context clearly requires otherwise:
City.
The words "the city" or "this city"
shall be construed as if followed by the words "of Placentia."
Code.
The words "the code" or "this code"
mean "The Placentia Municipal Code."
Computation of time.
The time in which any act provided by law is to be done is
computed by excluding the first day and including the last unless
the last day is a holiday and then it is also excluded.
Council—city council.
Whenever the words "council" or "city council"
are used in this code, they mean the city council of the city of Placentia.
County.
The words "the county" or "this county"
mean the county of Orange.
Day.
A day is the period of time between any midnight and the
midnight following.
Daytime—nighttime.
"Daytime" is the period of time between sunrise
and sunset. "Nighttime" is the period of time between
sunset and sunrise.
Gender.
The masculine gender includes the feminine and neuter.
In the city.
The words "in the city" mean and include all
territory over which the city now has, or shall hereafter acquire
jurisdiction for the exercise of its police powers or other regulatory
powers.
Joint authority.
All words giving a joint authority to three or more persons
or officers shall be construed as giving such authority to a majority
of such persons or officers.
Month.
The word "month" means a calendar month.
Number.
The singular number includes the plural, and the plural the
singular.
Oath.
"Oath" includes an affirmation.
Officers, departments, etc.
Officers, departments, boards, commissions and employees
referred to in this code shall mean officers, departments, boards,
commissions and employees of the city of Placentia, unless the context
clearly indicates otherwise.
Official time.
Whenever certain hours are named in this code, they mean
Pacific Standard Time or Daylight Saving Time, as may be in current
use in the city.
Or—And.
"Or" may be read "and," and "and"
may be read "or," if the sense requires it.
Owner.
The word "owner," applied to a building or land,
includes any part owner, joint owner, tenant in common, tenant in
partnership, joint tenant or tenant by entirety of the whole or of
a part of such building or land.
Person.
"Person" includes any person, firm, association,
organization, partnership, business trust, corporation or company.
Personal property.
"Personal property" includes every species of
property, except real property, as defined in this section.
Preceding—Following.
The words "preceding" and "following"
mean next before and next after, respectively.
Process.
"Process" includes a writ or summons issued in
the course of judicial proceedings of either a civil or criminal nature.
Property.
The word "property" includes real and personal
property.
Real property.
"Real property" includes lands, tenements and
hereditaments.
Shall, may.
"Shall" is mandatory and "may" is
permissive.
Signature or subscription by mark.
"Signature" or "subscription" includes
a mark when the signer or subscriber cannot write, such signer's
or subscriber's name being written near the mark by a witness
who writes his own name near the signer's or subscriber's
name; but, a signature or subscription by mark can be acknowledged
or can serve as a signature or subscription to a sworn statement only
when two witnesses so sign their own names thereto.
State.
The words "the state" or "this state"
shall be construed to mean the state of California.
Tenant or occupant.
The words "tenant" or "occupant,"
applied to a building or land, include any person holding a written
or an oral lease of, or who occupies the whole or a part of such building
or land, either alone or with others.
Tenses.
The present tense includes the past and future tenses, and
the future includes the present.
Week.
A week consists of seven consecutive days.
Writing.
Writing includes any form of recorded message capable of
comprehension by ordinary visual means. Whenever any notice, report,
statement or record is required or authorized by this code, it shall
be made in writing in the English language, unless it is expressly
provided otherwise.
Year.
The word "year" means a calendar year, except
where otherwise provided.

The court, when imposing any judgment or sentence under and
pursuant to any provision of this code or other ordinance of the city
or any statutory law of the state, is authorized to order any commitment
to jail to be carried out by commitment in the county jail.

It is unlawful for any person to wilfully make or file, on his own behalf or for any other person, firm or corporation, a false or misleading statement or misrepresentation, oral or written, under any form of oath or declaration, to the city council or any city officer. The prohibition contained in this chapter shall apply to all applications, matters or issues in which the city has an interest in the protection of the public welfare. Violation of this section constitutes a misdemeanor pursuant to Section
1.08.010.

It is unlawful for any person, on his or her own behalf or for any other person, firm or corporation, to make or file a false or misleading oral or written report to the police or fire department, or any other department of the city of Placentia, for the purpose of causing said departments to make an investigation of the subject matter of such report or for the purpose of misleading any employee officially acting in said departments. Violation of this section constitutes a misdemeanor pursuant to Section
1.08.010.

The city shall not be and is not bound by any contract, except
as otherwise provided herein, unless the same shall be made in writing,
approved by the city council, and signed on behalf of the city by
the mayor, member of the city council or by such officer or officers
as shall be designated by the city council. Any of said officers shall
sign a contract on behalf of the city when directed to do so by the
city council. The term "contract" shall mean and include
any addendum, amendment, alteration, modification or rescission of
a contract.
The approval of the form of the contract by the city attorney
shall be endorsed thereon, in writing, before the same shall be signed
on behalf of the city. The city council, by ordinance duly adopted,
may authorize the city administrator, or designee, to bind the city
without a contract in writing for the payment of services, supplies,
materials, equipment and labor or other valuable consideration furnished
to the city in an amount not exceeding the limit established by ordinance
of the city council.

In accordance with the provisions of Section 608 of the Charter
of the city of Placentia, all public works contracts issued by the
city shall comply with the requirements of California
Labor Code Section
1782 and the requirements of Chapter 2.8 of the California Public
Contracts Code on and after January 1, 2015.
