An employee, individually or in representation of a group of employees, may complain to city management through the grievance procedure in this chapter regarding any non-disciplinary matter relating to that employee’s wages, hours, or conditions of employment. A grievance may be either formal or informal. An informal grievance is a prerequisite to filing a formal grievance.

An employee, individually or in representation of a group of employees, with a grievance shall first discuss the matter with his or her immediate supervisor within 10 calendar days after the employee or group of employees discovered, or should have discovered through the exercise of reasonable diligence, the event giving rise to the grievance. The supervisor and the employee shall attempt to informally resolve the dispute. If this is not accomplished, the employee shall next discuss the matter with the next level of supervision within 10 calendar days of the unsuccessful discussion and so on, until the employee reaches the department head. The decision of the department head regarding an informal grievance shall be final unless the employee files a formal grievance.

A. 
Written Grievance. An employee, individually or in representation of a group of employees, who has a grievance which remains unresolved after utilizing the informal grievance may file a formal grievance in writing. The employee shall file a formal written grievance with the city manager within 10 calendar days after the final decision on the informal grievance. The formal grievance shall contain all relevant information relating to the grievance which the employee wishes the city manager to consider. The city manager shall meet with and respond in writing to the employee within 10 calendar days of the receipt of the grievance.
B. 
Disposition. Except in those cases where the grievance is subject to administrative appeal to the personnel board pursuant to Chapter 3.23, the decision of the city manager regarding a formal grievance is final.
