(a)
The purpose of these regulations
is to establish principles for outdoor lighting:
(1)
All outdoor lighting shall have a
clear purpose.
(2)
Light shall be directed only where
it is needed, being targeted and shielded to eliminate light trespass
and minimize light pollution. Full shielding shall be used for all
luminaires with an initial luminaire lumens specification of higher
than 1,000 lumens.
(3)
Light shall be no brighter than necessary
to meet its purpose.
(4)
Lights shall be used only when needed.
Lighting shall be dimmed by at least 30% or extinguished during the
curfew hours, but lighting to identify the property and the address
number shall only be dimmed and shall not be extinguished to allow
emergency services to locate the property.
(A) The lighting curfew
for residential properties shall extend from midnight to one hour
before daylight. Lighting shall be dimmed by at least 30% or extinguished
during the curfew hours.
(B) The lighting curfew
for all other properties shall extend from one hour after closing
to one hour before opening. Lighting shall be dimmed by at least 30%
or extinguished during the curfew hours.
(C) The lighting curfew
for commercial signs shall extend from one hour after closing to one
hour before opening. Lighting shall be dimmed by at least 30% or extinguished
during the curfew hours.
(5)
Luminaires shall use lamps with a
color temperature of less than 3,0000 Kelvin.
(6)
Luminaires shall be installed to
promote the even distribution of light while minimizing sharp contrasts
between lit areas and the darker surroundings.
(7)
All new outdoor lighting shall meet
dark sky friendly criteria.
(b)
Applicability and grandfathering.
(1)
All exterior lighting installed after
the effective date of this article must comply with these requirements.
(2)
Grandfathering shall lapse and existing
exterior lighting for the site shall comply with these requirements
upon crossing any one of the following thresholds.
(A) The property owner repairs
or replaces more than 50% of the value of the luminaires, whether
by a single action or by a series of cumulative actions.
(B) If the property owner
completes an addition with more than a 50% increase in building area,
number of units, or number of parking spaces, whether by a single
action or by a series of cumulative actions.
(c)
Exceptions.
(1)
The following exceptions are defined
by right for any residential property, subject to the lighting curfew:
(A) Low-intensity light
strings in the side or back yards.
(B) Low-intensity temporary
lighting for holidays or other events.
(C) Low-intensity architectural
lighting, landscape lighting or ornamental lighting.
(2)
The following exceptions may be granted
by the code official upon review and determination that they will
not be a light nuisance and that they meet the dark sky principles,
subject to the lighting curfew:
(A) Uplighting of public
art, public monuments, steeples and other landmarks of religious properties,
clock towers, or flagpoles.
(B) Light string wrapping
or uplighting of trees.
(3)
The following exemptions from the
lighting curfew are defined by right:
(A) Low-intensity outdoor
lighting consisting of only one luminaire for a property.
(B) Lighting for entrances,
walkways, or steps as required by code or necessary for safety.
(D) Motion-activated lighting
which is deactivated after no more than fifteen minutes of inactivity.
(4)
Exemptions from the lighting curfew
may be granted by the code official upon review and determination
that they will not be a light nuisance and that they meet the dark
sky principles.

(a)
Base maximum. The maximum limit on total lighting for any site shall be defined
using the IDSA prescriptive method. This method calculates the site
lighting as the sum of the initial luminaire lumens as specified for
each lamp by the manufacturer, divided by the total square feet of
hardscape. The base maximum allowable site lighting is 2.50 lumens
per square foot of hardscape.
(b)
Additional allowable site lighting.
Additional lighting above the base
level is permitted in order to accommodate special needs for more
illumination.
(1)
An additional 2.50 lumens per square
foot of hardscape is permitted for multifamily residential, commercial,
and the AV, GUI, HM, M, and MMC zoning districts.
(2)
An additional 16.00 lumens per square
foot of hardscape is permitted for outdoor sales displays and uncovered
display areas, not including driveways, parking, or other nondisplay
areas.
(3)
An additional 8,000 lumens per drive-through
window is permitted under the canopy for an active drive-through windows.
(4)
An additional 16,000 lumens per pump
is permitted for vehicle gas or service stations under the canopy,
focused on the individual gas pumps.
