"Shared mobility device"
means any electric scooter, bicycle or similar device that is: (1) offered for use on a short-term use or rental basis (usually through an application on a mobile device); (2) designed for moving one (1) or more persons by means of human or electric power, or any combination thereof; and (3) not required to be returned to a specific origin or destination point. A "shared mobility device" may include bicycles, electric bicycles and electric scooters, but shall not include any of the following: a motorcycle, as defined in Section 400 of the California Vehicle Code; a motor-driven cycle, as defined in Section 405 of the California Vehicle Code; a motorized bicycle or moped, as defined in Section 406 of the California Vehicle Code; an electric personal assistive mobility device as defined in Section 313 of the California Vehicle Code.

Any mobility sharing device is prohibited within the City of Indian Wells.

(a) 
The City shall have the authority to remove and impound any mobility sharing device that is found within any public right-of-way in violation of this Chapter.
(b) 
The City may dispose of any impounded mobility sharing device if unclaimed by the mobility sharing operator after thirty (30) days following the date that the City notifies the entity responsible for deployment of such mobility sharing device.
