This chapter shall apply to non-medical marijuana activity. Laws pertaining to medical marijuana are contained in Chapter 8.60.

The definitions in Business and Professions Code Section 26001, as the same may be amended from time to time, apply to this chapter and are incorporated herein by reference.

(a) 
Non-medical commercial marijuana activity of all types (including cultivation, possession, manufacture, distribution, processing, storing, laboratory testing, labeling, transportation, distribution, delivery, or sale of marijuana and marijuana products) is prohibited. No person shall operate, manage, conduct, or engage in non-medical commercial marijuana activity.
(b) 
No person shall own, operate, manage, conduct, or work in, whether as an employee or independent contractor, a non-medical commercial marijuana business or facility.
(c) 
The establishment or operation of one or more types of businesses licensed under Division 10 (commencing with Section 26000) of the California Business and Professions Code is prohibited. No person shall establish or operate one or more of the types of businesses licensed under Division 10 (commencing with Section 26000) of the California Business and Professions Code.

(a) 
No person shall cultivate non-medical marijuana in any location except within a private residence, or inside an accessory structure to a private residence located on the grounds of a private residence that is fully enclosed and secure. The cultivation of non-medical marijuana authorized by this subsection (a) is limited to six live plants. No person shall cultivate more than six live non-medical marijuana plants at any one time.

Outdoor planting, cultivating, harvesting, drying, or processing of non-medical marijuana is prohibited. No person shall plant, cultivate, harvest, dry, or process non-medical marijuana in any outdoor location.

Any violation of this chapter is unlawful and subject to all criminal, civil, and administrative penalties, remedies, and provisions set forth in Title 1 of this code.
