The city council shall establish, by ordinance or resolution, parking restrictions for the municipally owned parking lots.

The city council shall establish by ordinance or resolution spaces for all-day employee parking in the municipally owned parking lots.

The management and operation of municipal parking lots under this division shall be by the city manager or his or her designee. Management and operation shall include, but not be limited to, the definition of the manner of payment for the privilege of parking, the manner of displaying the evidence of said privilege and the manner of posting designated parking spaces.

All motor vehicles parked upon any City of Escondido parking lot with a City of Escondido parking permit must properly display the permit in accordance with this division and/or the additional directives of the city manager or his or her designee.
(a) 
The City of Escondido parking permit shall be affixed to the exterior surface of the lower-most portion of the rear window, in a seven inch square farthest removed from the driver. If the motor vehicle is not equipped with a rear window or the permit cannot be clearly seen when placed on the rear window, the permit shall be affixed to the exterior surface on the right rear of the vehicle. The permit must be clearly visible 20 feet to the rear of the vehicle.
(b) 
Motorcycles. If the motor vehicle is a motorcycle, the permit may be displayed on any portion of the vehicle where the permit is clearly visible 20 feet to the rear. The permit may also be affixed to the front fork tubes where the permit is clearly visible 20 feet to the front.
(c) 
Customer permits; Special permits; Unassigned permits. When a customer permit, special permit or unassigned permit is used, the permit shall be displayed by attaching the permit hangar to the vehicle's rear view mirror. The face of the permit shall face forward and be clearly visible 20 feet to the front of the vehicle. If the permit hangar cannot be attached to the mirror, the permit must be displayed on the driver's side dashboard of the vehicle and must be clearly visible through the windshield. A vehicle displaying a customer permit shall be exempt from overtime parking violations both on street and in City of Escondido parking lots. A vehicle displaying a special permit or unassigned permit shall be exempt from overtime parking violations while parked upon any City of Escondido parking lot.

No person shall park any motor vehicle upon a City of Escondido parking lot, which displays an expired City of Escondido parking permit.

If any City of Escondido parking permit is stolen, lost, mutilated or illegible, the owner of record shall immediately make application for a new permit. The City of Escondido shall issue a duplicate permit upon the registered owner furnishing information satisfactory factory to the city.

(1) 
Any person who, with the intent to defraud:
(a) 
Alters, forges, counterfeits or falsifies a City of Escondido parking permit;
(b) 
Utters, publishes, passes or attempts to pass, as true and genuine, any false, altered, forged or counterfeit City of Escondido parking permit;
(c) 
Acquires, possesses, sells, or offers for sale any false, altered, forged or counterfeit City of Escondido parking permit.
(2) 
Any person found in violation of this section is guilty of a misdemeanor. A conviction for the violation of this section shall be grounds for the revocation of the violator's right to apply for subsequent Escondido parking permits.

No person shall display upon a motor vehicle any City of Escondido parking permit not issued to that vehicle. This section shall not apply to customer parking permits, unassigned permits or other special permits issued by the city manager or his or her designee. Customer permits may only be used by customers of the business, to which the permit is issued, for the time necessary to conduct their business.

Any violation of this division except for section 194 is an infraction. A first violation of this division may be dismissed with a proof of correction submitted to the parking enforcement department of Escondido police department. Any subsequent violation of this section is an infraction and the penalty for such a violation shall be in conformity with the penalties for overtime parking violations as set forth in this code. Any valid parking violation that is later dismissed, due to proof of correction, is subject to a ten dollar ($10.00) processing fee.
