Groundwater, spring water or lake water may be pumped, extracted
and/or bulk stored for municipal and/or quasi-municipal purposes for
distribution through a public water system or for municipal fire protection
services, at locations where permitted subject to the approval of
the Selectboard. The Selectboard shall grant final approval if it
finds that the proposal, with any reasonable conditions.
A. No conditions of extraction may occur without exception, unless with
Selectboard special approval.
(1) No commercial companies may extract water from waterways and for
solely commercial purposes unless without special permission by the
Selectboard for emergency circumstances.
(2) Safe and healthful conditions will be maintained at all times within
and about the proposed use.
(3) The proposed use will not cause sedimentation or erosion.
B. Nothing in this procedure and no decision by the Selectboard shall
be deemed to create groundwater rights other than those rights which
the applicant may have under Maine law.
No activity shall locate, store, discharge, or permit the discharge
of any treated, untreated, or inadequately treated liquid, gaseous,
or solid materials of such nature, quantity, obnoxiousness, toxicity,
or temperature that run off, seep, percolate, or wash into surface
water or groundwater so as to contaminate, pollute, or harm such waters
or cause nuisances, such as objectionable shore deposits, floating
or submerged debris, oil or scum, color, odor, taste, or unsightliness,
or be harmful to human, animal, plant, or aquatic life.
