The Director shall issue a permit upon approval of a site map and grading plan, interim plan: and where required, final plan, soil report, and geology report, deposit of appropriate security and payment of fees. Permit shall be issued subject to the following conditions:
A. 
The permittee shall maintain a copy of the permit, approved plans and reports required under Section 21.12.020 on the worksite and available for public inspection during all working hours;
B. 
The permittee shall, at all times, be in conformity with approved site map and grading plan, interim and final plans.

In addition to performing as required under Section 21.12.010:
A. 
Unless this requirement is waived in writing by the Director, permittee shall notify the Director within seventy-two hours of:
1. 
The beginning of the permitted activity,
2. 
The completion of rough grading,
3. 
The completion of finished grading,
4. 
The installation of all temporary erosion control devices and the completion of planting requirements,
5. 
Readiness of the site for final inspection, including, but not limited to, finished grading, installation of drainage devices and final erosion control measures:
B. 
Permittee shall submit to the Director reports if:
1. 
There are delays in obtaining materials, machinery, services or manpower necessary to the implementation of the grading, interim or final plans as scheduled.
2. 
There are any delays in land-disturbing or filling activities or soil storage,
3. 
The work is not being done in conformance with the approved grading plan. interim or final plans,
4. 
There are any departures from the approved grading plan which may affect implementation of the interim or final plans as scheduled,
5. 
There are any delays in the implementation of the interim or final plans,
6. 
There are any other departures from implementation of the interim or final plans:
C. 
Unless this requirement is waived in writing by the Director, permittee shall submit recommendations for corrective measures, if necessary and appropriate, with the reports made under subsection B of this section.

A. 
The Director shall review all reports submitted by permittee. The Director may require permittee to modify the site map and grading plan, interim or final plans, and maintenance methods and schedules. The Director shall notify the permittee in writing of the requirement and specify a reasonable period of time within which permittee must comply. All modifications are subject to Director's approval.
B. 
The Director may inspect the site:
1. 
Upon receipt of a report by permittee under provisions of subsections A and B of Section 2 1.12.020;
2. 
To verify completion of modifications required under subsection A of this section;
3. 
During and following any rainfall;
4. 
At any other time, at the Director's discretion.

A. 
Upon completion of the rough grading work and at the final completion of the work, the Director may require the following reports and drawings and supplements thereto:
1. 
An as-graded grading plan prepared by the civil engineer including original ground surface elevations, as graded ground surface elevations, lot drainage patterns and locations and elevations of all surface and subsurface drainage facilities. The civil engineer shall provide approval that the work was done in accordance with the final approved grading plan;
2. 
A soil grading report prepared by the soils engineer including locations and elevations of field density tests, summaries of field and laboratory tests and other substantiating data and comments on any changes made during grading and their effect on the recommendations made in the soil engineering investigation report. The soils engineer shall provide approval as to the adequacy of the site for the intended use;
3. 
A geologic grading report prepared by the engineering geologist including a final description of the geology of the site including any new information disclosed during the grading and the effect of same on recommendations incorporated in the approved grading plan. The engineering geologist shall provide approval as to the adequacy of the site for the intended use as affected by geologic factors.
B. 
Upon correction of final grading and permanent improvements, where such permanent improvements are planned at the time grading is performed, permittee shall submit:
1. 
Executed contract(s) for maintenance and upkeep of final plan runoff and erosion control measures for a two year period; and
2. 
Copy(ies) of instructions to be given to the subsequent owner by permittee on maintenance of the final plan runoff and erosion control measures.

A. 
Any grading permit may be temporarily suspended by the Director pending a hearing on permanent suspension to be held within five working days for the violation of any condition of the permit, the violation of any provision hereof, or any other applicable law or ordinance, or the existence of any condition or the doing of any act constituting or creating a nuisance, threatening water quality, or endangering the lives or property of others.
B. 
A suspension shall be made permanent only after a hearing granted by the Director after at least five working days' written notice to the permit holder, stating generally the grounds of complaint and the time and place where such hearing will be held.
C. 
At the conclusion of said bearing, and within thirty days thereof, the Director shall make his or her findings and notify in writing the permit holder of the action taken.
D. 
Upon notification of temporary or permanent suspension of permit, permittee shall cease all work on the worksite, except work necessary to remedy the cause of the suspension.
E. 
The Director may revoke the permit, and permittee shall cease work if permittee fails or refuses to cease work, as required under subsection D of this section. after temporary or permanent suspension of the permit and notification thereof.
F. 
The Director shall reinstate a suspended permit upon permittee's correction of the cause of the suspension.
G. 
The Director shall not reinstate a revoked permit.
H. 
The permittee may request an appeal before the City Council within thirty days of notification of permanent suspension or revocation of permit. The hearing shall be held at the next regularly scheduled City Council meeting following the date of the request for an appeal.

The Director may act against the appropriate security if one of the conditions listed in subsections A through D below exists. The Director shall use funds from the appropriate security to finance remedial work undertaken by the City or a private contractor under contract to the City, and to reimburse the City for all costs incurred in the process of the remedial work.
A. 
The permittee ceases land-disturbing activities and/or filling and abandons the site prior to completion of the work as shown on the site map and grading plan;
B. 
The permittee fails to conform to the interim plan or final plan as approved or as modified under subsection A of Section 21.12.030 and has had his or her permit revoked under Section 2 1.12.050;
C. 
The techniques utilized under the interim or final plan fail within one year of installation, or before a final plan is implemented for the site or portions of the site, whichever is later,
D. 
The Director determines that action by the City is necessary to prevent excessive erosion from occurring on the site.

Security deposited with the City for faithful performance of the grading and erosion control work and to finance necessary remedial work shall be released according to the following schedule:
A. 
Grading Plan—Interim Plan. Securities held against the successful completion of the work as shown on the site map and grading plan and the interim plan, except for interim plans described in Section 21.08.180. shall be released to the permittee at the termination of the permit, provided no action against such security is filed prior to that date;
B. 
Final Plan. Securities held against the successful completion of the final plan and an interim plan described in Section 21.08.180 shall be released to the permittee either one year after termination of the permit or when a final plan is submitted for the unimproved site, whichever is later, provided no action against such security has been filed prior to that date.
