The City Manager as administrative head of the city government shall have the power to prescribe rules and regulations not in conflict with the Charter, ordinances, and resolutions of the Council under which officers, employees and departments shall operate. The City Manager shall also have the power and duty to supervise all activities of the officers and employees.

The City Manager may hire on a permanent or temporary basis, any employees necessary or beneficial to the proper administration of the city government; provided, however, that authority to fix their compensation shall be subject to the provisions of Section 79 of the Charter.

To the extent that the City Council has authorized an employee to request and receive administrative leave of absence without pay (whether by memorandum of understanding, Civil Service Rule, or other Council action), the City Manager is authorized to approve the administrative leave of absence without pay. The City Manager is authorized to place an employee on administrative leave of absence with pay to the extent that the City Manager documents that it is in the best interests of the city in order to conduct an investigation or administrative review of a potential disciplinary action, an employee involved incident, or an employee rehabilitation.

The City Manager shall take the proper measures for the preservation of the public order and suppression of riots, insurrections or tumults for which he or she is fully authorized and empowered to use all the police force of this city and to require every male person residing within the city above the age of 18 years, to join the posse comitatus.

The City Manager shall have the power, in conformity with this code, to grant such permits as shall be prescribed or required by this code unless another officer is specifically given this authority. Every person desiring to obtain any permit which the City Manager is authorized by this section to issue shall make application to the City Manager stating the permit desired, the person who desires the same, the time which it will remain in force, the place and the particular time when it will be exercised. If the City Manager is satisfied that such a permit should be granted, he or she shall endorse upon such application his or her written order therefor and said application and order endorsed thereon shall be filed in the office of the City Clerk who shall thereupon issue to the person named in the said order the permit so ordered, provided that if any fee shall be prescribed for the issuance of such permit, such fee shall be paid to the City Collector and his or her receipt therefor shall be endorsed on said permit before the same shall be valid or of any effect. The City Manager shall have the power to revoke any permit ordered by him or her when it appears to him or her that the same is used in an illegal, disorderly or improper manner.

The City Manager or designee is hereby authorized to permit the use of city-owned property including, but not limited to, city-owned parking lots for temporary private use (not to exceed five days). Such use shall be permitted upon determination that such use: (a) is consistent with the use of the property by the city; (b) is not overly disruptive to use of the property by the public at large; and (c) promotes a legitimate community and/or public purpose.

A. 
Designation of Appointive Officers. The City Council hereby designates the following appointive officers pursuant to Section 75 of the Charter:
1. 
Two (2) Assistant City Managers.
2. 
Risk Manager.
3. 
Community Relations and Media Manager.
4. 
Community Relations and Media Analyst.
5. 
Two (2) Management Analysts I/II.
6. 
Office Assistant I/II.
B. 
Authority and Duties. Each of the appointive officers designated pursuant to this section shall have the authority and duties prescribed by the City Manager, in accordance with class specifications approved by the City Council.
C. 
Exempt Status. Each of the appointive officers designated pursuant to this section are designated by the authority given the Council by Section 75 of the Charter, and shall not be subject to the provisions of Section 76.1 of the Charter. Accordingly, each of the appointive officers designated pursuant to this section are exempt from the civil service rules established pursuant to Section 76.1 of the Charter.
D. 
Appointment and Removal. Each of the appointive officers designated pursuant to this section shall be appointed by the City Manager, and may be removed at any time by the City Manager.
E. 
Unfilled Positions. Each of the appointive officers designated pursuant to this section may, in the discretion of the City Manager, be held open and unfilled, depending upon budget authorization approved by the City Council. Nothing in this section is intended to require the City Manager to either fill or hold open any unfilled position specified in this code.
