Pursuant to the authority granted by Section 49200 et seq. of the Health and Safety Code of the state, the board may issue franchises for the collection, transportation or disposal of refuse under the terms and conditions of this part.

The board may, by resolution, call for sealed bids for the granting of a franchise, exclusive or otherwise, for the collection, transportation or disposal, or any combination of such services, of refuse according to the terms and conditions set forth in the resolution, for a period of time not to exceed 25 years.

The resolution by the board shall contain the following information:
A. 
The number and duration of franchises to be issued.
B. 
The boundaries of each franchise area.
C. 
Whether each franchise is to be exclusive or otherwise.
D. 
The nature of the service, or services, to be covered by each franchise.
E. 
That each franchise and franchise holder is subject to, and must comply with, the provisions of this article.
F. 
That each bid shall set forth a schedule of fees proposed to be collected if a franchise should be issued.
G. 
The place and deadline for filing bids.
H. 
That all bids shall be sealed before filing.
I. 
The date, time and place for the opening of the sealed bids.

Subsequent to passage of the resolution, the board shall cause to be published, once a week, for two successive weeks, a notice which shall set forth all of the terms and conditions embraced in the resolution and the time, date and place for the receiving and opening of sealed bids which shall be not sooner than four full weeks from date of the first publication of the notice.

A bidder may in his or her franchise bid set forth such proposition terms and conditions as such bidder may desire to offer, or receive the benefit from which may be in addition to, or in conflict with, those mentioned in the resolution or advertised notice calling for bids, so long as they are not in conflict with this article, with Section 4200 et seq., of the Health and Safety Code of the state, or with Division 7 Section 17100 et seq. Title 14, California Administrative Code.

Upon examination by the board of the bids, the franchise may be awarded to the lowest qualified bidder in each franchise area; provided, however, that the board may postpone the granting of the franchise from time to time until it has had a full and complete opportunity to examine into the merits of each bid; and provided further, that the board may refuse to issue a franchise in any area if it finds that no bid for that area has been received which promotes the health, safety or welfare of the people in that area.

A successful bidder shall file with the board, upon grant of a franchise, a bond in favor of the county in an amount and under such terms and conditions as may be prescribed by the board.

If any franchise holder fails or refuses to comply with the provisions of this article, or the rules or regulations of the department, the department may immediately suspend the franchise.

Upon suspension of any franchise, the department shall then file notice of suspension with the board.

Upon receiving the notice provided for by the preceding section, the board shall then set a time and place of hearing which time shall be not less than seven days from the date the notice is filed. The board shall give the department and franchise holder written notice of the hearing date not less than seven days before the hearing. At the hearing the board shall hear all relevant evidence of the charges.

A franchise may be revoked only by a majority decision of the full membership of the board after the hearing required by the preceding section. If a franchise is not revoked, it shall again be in full force and effect.

Obligations include:
A. 
To maintain a central office within the county, where the franchise holder or his or her firm may be reached by telephone or in person during normal business hours.
B. 
Adherence to all conditions or requirements contained in the franchise bid documents.
C. 
To adhere to all applicable sections of this article and state law.

The collection, transportation, and disposal of all solid wastes with the exception of those wastes hauled by individual homeowners, is the exclusive right of the franchise holder. The hauling or collection of solid waste by firms other than the franchise holder is prohibited, except in those cases where a permit to haul is issued by the department.

A. 
Franchise Area No. 1, for the collection of garbage shall consist of:
1. 
All the western portion of Placer County, excluding the incorporated cities of Roseville, Rocklin and Lincoln and that parcel of property located in Section 35, T11N, R5E, known as Finger's Dump Site lying westerly of the hereinafter described line:
Beginning at a point, such point is the northeast corner of the fractional Section 34, T14N, R7E, such point also lies on the common boundary between Placer and Nevada Counties;
Thence from such point of beginning in a southerly direction the following three courses:
a. 
Along the easterly side of Section 34, T14N, R7E, to the northeast corner of Section 3, T13N, R7E;
b. 
Along the easterly side of Sections 3, 10, 15, 22, 27, 34, T13N, R7E, to the township line between T13N and T12N;
c. 
Along the easterly side of Sections 3, 10, 15, T12N, R7E, to the northeast corner of Section 22, T12N, R7E;
Thence easterly along the northerly boundary of Section 23, T12N, R7E, to the northeast corner of such section;
Thence southerly along the easterly boundary of Section 23, T12N, R7E, to the southeast corner of such section;
Thence easterly along the northerly boundary of Section 25, T12N, R7E, to the northeast corner of such section;
Thence southerly along the easterly boundary of Section 25, T12N, R7E, to the southeast corner of such section;
Thence easterly along the northerly boundary of Section 31, T12N, R8E, to the northeast corner of such section;
Thence southerly along the easterly boundary of Section 31, T12N, R8E, to the southeast corner of such section;
Thence easterly along the southern boundary of Sections 32, 33, and 34, T12N, R8E, to the Placer-El Dorado County boundary line and;
2. 
The area of Placer County described herein, except for the incorporated cities of Auburn and Colfax:
Beginning at a point, such point is the northeast corner of the fractional Section 34, T14N, R7E, such point also lies on the common boundary between Placer and Nevada Counties;
Thence from such point of beginning in a southerly direction the following three courses:
a. 
Along the easterly side of Section 34, T14N, R7E, to the northeast corner of Section 3, T13N, R7E;
b. 
Along the easterly side of Sections 3, 10, 15, 22, 27, 34, T13N, R7E, to the township line between T13N and T12N;
c. 
Along the easterly side of Sections, 3, 10, 15, T12N, R7E, to the northeast corner of Section 22, T12N, R7E;
Thence easterly along the northerly boundary of Section 23, T12N, R7E, to the northeast corner of such section;
Thence southerly along the easterly boundary of Section 23, T12N, R7E, to the southeast corner of such section;
Thence easterly along the northerly boundary of Section 25, T12N, R7E, to the northeast corner of such section;
Thence southerly along the easterly boundary of Section 25, T12N, R7E, to the southeast corner of such section;
Thence easterly along the northerly boundary of Section 31, T12N, R8E, to the northeast corner of such section;
Thence southerly along the easterly boundary of Section 31, T12N, R8E, to the southeast corner of such section;
Thence easterly along the southern boundary of Sections 32, 33, and 34, T12N, R8E, to the Placer-El Dorado County boundary line;
Thence from such point in a northeasterly direction along the common boundary between Placer and El Dorado Counties to the middle fork of the American River;
Thence in a northeasterly direction along the north fork of the American River to the north boundary of Section 1, T14N, R9E, such point also being on the township line between T14N and T15N;
Thence westerly along the north boundary of Sections 1, 2, and 3, T14N, R9E, to the quarter section line of section line of Section 34, T15N, R9E;
Thence northerly along such quarter section line to the north boundary of Section 34, T15N, R9E;
Thence westerly along the north boundary of Sections 34 and 33, T15N, R9E, to a point on the northerly boundary of said Section 33, such point also being on the Placer-Nevada County boundary, such point also being on the Bear River;
Thence in a southwesterly direction along the common boundary between Placer-Nevada Counties to the point of beginning.
B. 
Franchise Area No. 2, for the collection of garbage shall consist of the area described herein, except for a portion of the incorporated city of Colfax.
Beginning at a point on the northerly boundary of Section 33, T15N, R9E, such point also being located on the Placer-Nevada County boundary;
Thence easterly along the northern boundary of Sections 33 and 34, T15N, R9E, to the quarter section line in said Section 34;
Thence southerly along such quarter section line to the south boundary of said Section 34;
Thence easterly along the southerly boundary of Sections 34, 35, and 36, T15N, R9E, to the north fork of the American River;
Thence northeasterly along the north fork of the American River to the southeast corner of Section 15, T16N, R15E;
Thence north along the easterly boundary of Sections 15, 10 and 3, T16N, R15E, to the northeast corner of said Section 3;
Thence westerly along the north boundary of said Section 3 to the northwest corner of said Section 3;
Thence north along the easterly side of Sections 33, 38, 21, T17N, R15E, to the northeast corner of said Section 21;
Thence in a southwesterly direction from such point along the common Placer-Nevada County boundary to the point of beginning.
C. 
Franchise Area No. 3, for the collection of garbage shall consist of the area described herein:
1. 
Beginning at the northwest corner of Section 22, T17N, R15E, such section corner being located at a point on the boundary line between Placer and Nevada Counties;
Thence east along the Placer-Nevada County line a distance of 10 miles to the northeast corner of Section 19, T17N, R17E;
Thence south a distance of nine miles to the shoreline of Lake Tahoe;
Thence along such shoreline a distance of approximately 11 miles to a point on the Placer-El Dorado County line;
Thence southwesterly along the Placer-El Dorado County line a distance of approximately nine and one-half miles to the southwest corner of Section 30, T14N, R16E;
Thence north a distance of 11 miles to the northwest corner of Section 6, T15N, R16E;
Thence east along the north line of said Section 6 to the southwest corner of Section 31, T16N, R16E;
Thence north a distance of three miles to the northwest corner of Section 19, T16N, R16E;
Thence westerly two miles along the south boundary of Sections 13 and 14, T16N, R15E, to the southwest corner of Section 14, T16N, R15E;
Thence north three miles to the northeast corner of Section 3, T16N, R15E;
Thence west one mile to the southwest corner of Section 34, T17N, R15E;
Thence north a distance of three miles to the point of beginning and:
2. 
Beginning at the northwest corner of Section 20, T17N, R17E, such section corner being located at a point on the boundary line between Placer and Nevada Counties;
Thence south a distance of nine miles to the shoreline of Lake Tahoe;
Thence easterly along the said shoreline a distance of approximately 9 miles to a point on the California-Nevada state boundary line;
Thence north a distance of approximately 6 ½ miles to the northeast corner of Section 30, T17N, R18E, said point being on the California-Nevada state boundary line and the Placer-Nevada County boundary line;
Thence westerly along the boundary line between Placer and Nevada Counties a distance of approximately 6 miles to the point of beginning.
D. 
Franchise Area No. 4, for the collection of garbage shall consist of the area described herein:
Beginning at a point, said point being the junction of the south boundary of Section 1, T12N, R8E, and the Placer-El Dorado County boundary line;
Thence from said point of beginning northeasterly along the Placer-El Dorado County boundary line to the Southeast corner of Section 26, T14N, R15E;
Thence north along the east boundary of Sections 26, 23, 14, 11, and 2, T14N, R15E, Section 35, 26, 23, 14, 11, and 2, T15N, R15E, to the northeast corner of Section 2, T15N, R15E;
Thence easterly along the north boundary of Section 6, T15N, R16E, to the southeast corner of Section 36, T16N, R15E;
Thence north along the east side of Sections 36, 25, and 24, T16N, R15E, to the northeast corner of Section 23, T16N, R15E;
Thence west along the north boundary of Sections 24 and 23, T16N, R15E, to the northwest corner of Section 23, T16N, R15E;
Thence westerly along the North Fork of the American River to the confluence of the Middle and North Forks of the American River;
Thence along the Middle Fork of the American River to the point of beginning, said point of beginning being the intersection of the south boundary of Section 1, T12N, R8E, and the Placer-El Dorado County boundary line.
