It is the intent of the mechanical code to protect the public health and safety as they pertain to heating, venting, air conditioning (HVAC), refrigeration, and plumbing trades. The International Building Code and its sub-parts are the basis of this chapter and any exceptions to the International Building Code are so noted.

For the purpose of this chapter, the following words and phrases shall have the meanings respectively described to them by this section:
"Board of appeals"
means the board members as found in R.M.C. Chapter 2.48.
"Certificate" and "mechanic certificate"
means the WAM and/or ICC certificate issued for the respective trade classification.
"City certificate"
means the certificate issued by the city in acknowledgement of either the WAM or ICC certificate, or the city license issued to the contractor.
"Contractor"
means any person engaged in the business of installing, repairing, or altering mechanical equipment.
"Customer"
means any person for which any mechanical work is accomplished by the contractor.
"Inspector"
means the community development director, building official, or any of his or her duly authorized assistants or agents.
"International Code Council" and "ICC"
mean the organization that develops and issues building codes and administers exams for building officials and contractors.
"Limited plumbing contractor"
means a contractor who has been authorized by the city for specific plumbing projects.
"Mechanical"
means heating, venting, air conditioning (HVAC) trade, refrigeration trade, and the plumbing trade.
"Mechanical system"
means any and all parts of the respective system as it pertains to each trade starting at the water curb stop and sewer tap for plumbing, the electrical disconnect for the HVAC or refrigeration circuit, and the gas line shut off at the service meter.
"WAM"
means the Wyoming Association of Municipalities that administers ICC exams for contractors.
"WAM certification"
means the same as the ICC certification for the respective trade.

The building official, or their duly authorized assistant, shall maintain public office hours necessary to efficiently administer the provisions of this chapter and amendments thereto and shall perform the following duties:
A. 
Require submission of, examine and check plans and specifications, drawings, descriptions and diagrams necessary to show clearly the character, kind and extent of mechanical work covered by application for a permit and upon approval thereof shall issue the permit applied for.
B. 
Administer and enforce the provisions of this chapter in a manner consistent with the intent thereof and shall inspect all mechanical work authorized by any permit to assure compliance with provisions of this chapter or amendments thereto, approving or recommending such work in whole or in part as conditions require.
C. 
Issue upon request a certificate of approval for any work approved by him or her.
D. 
Condemn and reject all work done or being used which does not in all respects comply with the provisions of this chapter and amendments thereto.
E. 
Order changes in workmanship or materials essential to obtain compliance with all provisions of this chapter.
F. 
Investigate any construction or work regulated by this chapter and issue such notices and orders as provided in this chapter.
G. 
Keep a complete record of all the essential transactions of his or her office.
H. 
Maintain a complete record of all persons lawfully entitled to carry on or engage in mechanical work and to whom a certificate of qualifications has been issued in accordance with the provisions of this chapter.
I. 
Carry proper credentials of their respective office, upon exhibition of which they shall have the right of entry, during normal business hours, to inspect any and all buildings and premises in the performance of their duties.

A. 
Required. With the exemption hereinafter provided, no person shall engage in the business of installing mechanical systems or their sub-systems in or on any building or premises within the city limits without first procuring a certificate of their respective trade and trade classification from either WAM and/or the ICC. If this person engages in multiple trades, separate trade certificates will be required.
B. 
Issuance. The community development department shall verify the WAM/ICC certification, maintain a copy in the department files, and issue a city certificate.
C. 
Registration. Contractors performing work within the city limits must register with the city.
D. 
Fees. Fees are determined by the contractor registration program.
E. 
Certification. All mechanical contractors performing work within the city limits must be certified by the WAM/ICC and maintain their respective certification for trade and classification.
F. 
Exemption.
1. 
Anyone who has taken a city trade examination and now holds a city license for HVAC and/or plumbing is exempt from complying with the WAM/ICC certificate requirement.
2. 
Residential property owners may perform mechanical work within or on premises occupied by them without being certified. A permit for the work is still required.

A. 
Master mechanic may be either the owner or superintendent of the business holding a valid WAM/ICC certificate or current city license.
B. 
A master mechanic city certificate shall be issued to any applicant who shows proper qualifications by experience and examination in accordance with the following provisions:
1. 
The applicant must show proof of WAM/ICC certification; and
2. 
Applicant for master mechanic certification must submit an abstract of their education and experience indicating a minimum of five years of employment as a journeyman mechanic.

A. 
A journeyman city certificate shall be issued to any applicant who shows proper qualifications by experience and examination in accordance with the following provisions:
1. 
The applicant must show proof of WAM/ICC certification; and
2. 
Applicant for journeyman certification must submit an abstract of their education and experience indicating a minimum of four years of employment as a journeyman mechanic, or two years in mechanical engineering or approved apprenticeship training program and two years employment in the trade.

A. 
Every job site will have a minimum of one master or journeyman mechanic.
B. 
There shall be no more than two apprentice mechanics per master, or journeyman, mechanic on the site.
C. 
An apprentice shall not work on any job site without supervision.

A. 
Building permits are required prior to commencing work for all types of mechanical work with exception to those listed in Section 106 of the International Mechanical Code, International Plumbing Code, and International Fuel Gas Code.
B. 
Permits may be obtained by the master mechanic of respective trade or the property owner and either shall pay for said permit at time of issuance.
C. 
All work shall be inspected and it shall be the duty of the person performing the work authorized by said permit to call for inspections.
D. 
Inspector has the right to require noninspected covered work to be exposed, at permit holder's expense, to perform inspections of said work.
E. 
Appeals of decisions by the permit holder, or building official or their agent, may be taken to the board of appeals. Such appeal must be made to the community development department within five days of date of disputed ruling.

This chapter shall not be construed to relieve from or lessen the responsibility of any person owning, operating, or installing any mechanical system, for damage to anyone injured by any defect therein; nor shall the city, or any agent thereof, be held as assuming any such liability by reason of the inspection authorized in this chapter or the tag of inspection or approval issued by the mechanical inspector.

A. 
Required to be issued a city certificate as directed by the building official or their agent.
B. 
Is restricted to the installation, repair, or replacement of: (1) sanitary sewer lateral lines and water service lines that are located between their respective main line and the structure being served, and (2) sanitary sewer mains and water mains as directed or contracted by the city.
C. 
Will coordinate their projects with the city.

Any person violating any provision of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a sum of not less than $750.
