A. 
Establishment of Fees
In addition to the on-site drainage facilities required to be constructed under Chapter 17.016, drainage fees shall be paid in conjunction with subdivision or development in order to help defray the cost of off-site drainage facilities required to accommodate the additional water runoff created by development. Such fees shall be placed in the drainage fund account and used to implement the City's drainage construction plan or reimburse the City for expenditures previously made.
B. 
Fees by Zoning District
Such fees shall be apportioned by zoning districts, as shown on the City's Official Zoning Map. The fees established for each zoning district are based on the estimated contribution of storm flows created by the improvement of property within each such district.
C. 
Basis of Fee Structure
The fee structure adopted by the City shall be computed so that the drainage fee for the development of any property will not exceed the pro-rata share of the total cost of all needed drainage facilities within the City, were such costs apportioned uniformly on a contributory basis. In addition, a discount from the standard drainage fee is offered for the reduction of runoff, by means of on-site retention measures, which would otherwise occur from the development.

All fees collected pursuant to this chapter shall be deposited in a special fund, to be known as the "Drainage Facilities Fund." Monies in said fund shall be administered by the City and shall be expended solely for design and construction, or reimbursement for construction, of drainage facilities designated in the Drainage Master Plan.

No final tract or parcel map or final record of survey shall be approved until the fee provided per this chapter for the applicable zoning district has been paid in cash. However, the City reserves the right to waive payment of drainage fees for the dedication of rights-of-way, low income housing, or RDA economic benefits.

The drainage fee to be paid for any land being subdivided or developed in each of the zoning districts shall be determined by formulas established by separate ordinance. The formulas to be used for the computation of drainage fees shall be based on the acreage of development, the applicable zoning district, and the cost-per-unit drainage outflow figures specified in said ordinance, and amended from time to time.

When a zone change is adopted to change the current zoning of an area, expand a zoning area, or create a new zone district and such amendment has been in effect for a period of 60 days in the case of residential development or 30 days in the case of all other types of development, all of the provisions of this chapter shall apply to said area as though it was in the new zoning district when this chapter first became effective.
