For purposes of this chapter, the following terms shall have the following meanings:
"Figure model"
shall mean any person, male or female, who poses to be observed, viewed, sketched, painted, drawn, sculptured, photographed or otherwise similarly depicted.
"Model studio"
shall mean any premises wherein figure models are furnished for persons who pay a fee therefor and whose major purpose is the offering of a service which is intended to provide sexual stimulation or sexual gratification to the customer.

Exemptions. A license for a model studio shall not be required for:
(a) 
Any studio which is operated by any state college, or public junior college or school which has met the requirements established in Division 14 of the Education Code for the issuance or conferring of an academic or honorary diploma and is in fact authorized thereunder to issue and confer such diplomas; or
(b) 
Any premises where there is conducted the business of furnishing, providing or procuring figure models solely for any studio described in the preceding subsection.
2. 
Issuance Restrictions. A model studio license shall not be issued to any person under twenty-one years of age or to a corporation or partnership any of whose officers or partners are under twenty-one years of age.

In addition to the information prescribed by the Director, an application to operate a model studio shall include the following information:

In the event the applicant is not the owner of record of the real property upon which the model studio is or is to be located, the application must be accompanied by a notarized statement from the owner of record of the property acknowledging that a model studio is or will be located on the property. In addition to furnishing such notarized statement, the applicant shall furnish the name and address of the owner or record of the property, as well as a copy of the lease or rental agreement pertaining to the premises in which the model studio is or will be located.

Manager Required. Any person licensed to operate a model studio shall employ a manager on the premises at all times during which the model studio is open.
2. 
Hours of Operation. A person shall not conduct or operate a model studio between the hours of 10:30 p.m. and 9:00 a.m. of the following day.
3. 
Visibility of Interior. A model studio licensee shall ensure that the interior of the model studio is not visible from outside the premises in which the studio is located.
4. 
Recordkeeping Requirements. A person operating a model studio shall maintain a current file of all figure models who are employed by him or her or who use the premises. This file shall contain the true names and aliases, if any, used by the figure models, their age, birth date, height, weight, color of hair and eyes, home address, phone numbers, social security numbers, and the date of employment and termination. Inactive file cards shall be maintained on the premises for the period of one year following termination of any figure model.
5. 
Entertainment by Models Prohibited. A license issued pursuant to this chapter does not permit any entertainment as defined by Chapter 5.44.
6. 
Age Restrictions. A person conducting a model studio shall not employ any person under eighteen years of age unless such employment is approved by the Commission and that approval is expressly stated on the license for a model studio.
7. 
Alcoholic Beverages Prohibited. No model studio licensed pursuant to this chapter shall permit the possession, consumption, or use of alcoholic beverages on the licensed premises.
