A. 
Notwithstanding any other provision of this code, including, but not limited to, sign regulations set forth in Chapter 17.120 of this code, banner signs shall only be allowed as provided for herein. The Director of Community Services may authorize the temporary placement of banner signs in the locations specified in Section 12.44.030 on City property where those banners display the name and/or date of an event and/or activity sponsored entirely by the City or co-sponsored by the City that calls attention to the City, its natural advantages, resources, enterprises, attractions, climate, facilities, businesses or community. Banners displaying a nonprofit organization event are permitted under this section. The City Council hereby declares that the City has a compelling interest in creating a restricted, non-public forum to advertise City resources, City-sponsored or co-sponsored events, and nonprofit organization events.
B. 
Such banners shall be allowed for only a limited duration and must call attention to the City, its natural advantages, resources, enterprises, attractions, climate, facilities, business and community.
C. 
Such banners shall not be allowed to impede the visibility of any regulatory signage.
D. 
The City reserves the right to install a banner of its own creation, without regard to the requirements of this section, for events planned, held and/or produced by the City itself.
E. 
The City reserves the right to not install one or more banners, regardless of whether such banners comply with the requirements of this banner program.

"Banner sign"
means a strip of cloth or other flexible material meeting the design specifications included in Section 12.44.040 on which a sign or message is painted calling attention to the City, its natural advantages, resources, enterprises, attractions, climate, facilities, business and community.
"City co-sponsored event"
means any public event, program or activity in which the City allows the use of its name and/or logo by another sponsoring organization with regards to conduct of the event as well as advertising, promotion or general public awareness. In addition to the use of its name and/or logo, the City may assist by means of personnel, facilities and services in the preparation and conduct of the event.
"City-sponsored event"
means any public event, program, or activity which is directly related to a recognized function of the City, which is initiated, and in major part financed and executed by the City.
"Nonprofit organization event"
means a 501(c)(3) nonprofit organization located in Woodland that is hosting an event in Woodland for the general public to attend where the primary function is to raise charitable donations for the organization.
"Special event"
means an event and/or activity:
1. 
Sponsored entirely by the City, or co-sponsored by the City, or a nonprofit organization event;
2. 
Of limited duration as provided for herein;
3. 
That may or may not involve an assembly of persons;
4. 
That may or may not require a permit under the Woodland Municipal Code; and
5. 
That calls attention to the City, its natural advantages, resources, enterprises, attractions, climate, facilities, business and community.

This chapter specifically applies to only the following locations:
A. 
Main Street—"Main Street Spanning Banner." A street spanning banner pole system is located on Main Street approximately 50 feet west of the intersection of Main Street and Second Street.
B. 
Main Street—"Light Pole Banners." City-owned light poles along Main Street between Third Street and Elm Street that display banners (28 locations).
C. 
Main Street and East Street Banners—"Main/East Street Banner." Banner structure is located at the northwest corner of Main Street and East Street. The reference to Main/East Street Banner also includes the banner structure that is located at Main Street and County Road 98.

A. 
The Community Services Director, or designee, shall approve the design of all coloring, typeset, materials used and manner of placement.
B. 
Banner design shall be approved by the Community Services Director, or designee, prior to the issuance of a banner permit to ensure consistency with this policy and specifications. An exact copy or reproduction of the approved banner (which may include a snapshot or photograph, if the banner is too large for photocopy reproduction) shall be attached to and made part of the permit. Existing banners which meet the intent but not exact form as shown above shall be allowed until replaced or changed. Deviation from the approved wording is cause for either the refusal to install or the removal of any banner.

A. 
Each banner permit shall be valid for a duration of not less than one calendar week and not more than four calendar weeks. The length of the banner being displayed will depend on the overall banner schedule and when the next banner will be installed. City banners, exempt from a banner permit, shall not be limited to the four calendar week requirement.
B. 
Banners shall be installed and removed by the City's Public Works Department, or designated contractor through an agreement between the City and the contractor. The City shall not be responsible for any damage to banners.
C. 
The City reserves the right to remove any damaged or vandalized banners during the display period.

A. 
A banner permit fee of $100.00 will be charged for non-city-sponsored events. The fees shall be paid at the time of issuance.
B. 
Main Street Spanning Banner. Installation and removal fees will be charged to each organization installing banners. These fees will be the actual pass-through fee from the contractor the Public Works Department contracts with, or the public works crews installing the banners.
C. 
Light Pole Banners. No fees will be charged for the installation of light pole banners. Light pole banners will only be used for City-sponsored events, attractions, or existing community historic ongoing events (i.e., First Friday Art Walk, National Ag Week, Scottish Games, Woodland Farmers Market, Yolo County Fair, and Stroll Through History).
D. 
East/Main Street Banner. A banner permit fee of $100.00 will be charged for non-City-sponsored events. The fee shall be paid at the time of issuance.
E. 
Notwithstanding the foregoing, the City Manager may waive or reduce the banner permit processing fee for nonprofit organizations and other entities that are part of a City-sponsored or co-sponsored event that serve a public purpose as recognized by the City in the City Manager's sole discretion.
F. 
To recognize the contribution of Sunrise Rotary, Noon Rotary, and Luna Vista Rotary for the construction and financial contribution of the banner poles for the Main Street Spanning Banner, installation and removal fees will be waived for three banners for each organization. After three banner waiver fees have been granted for each individual organization, requirements of subsection B of this section apply.

A new banner schedule shall be established each year by January 10th. Banner permit applications shall be received no later than December 1st of the previous year. Sunrise Rotary, Noon Rotary, and Luna Vista Rotary shall each have priority use of the Main Street Spanning banner for two weeks prior to each of their main fundraising events (one per year for each organization). Sunrise Rotary, Noon Rotary, and Luna Vista Rotary shall submit a permit application no later than December 1st of the previous year. After the Rotary Club priority use of the Main Street Spanning Banner, the order of priority for banner use is: City-sponsored events/resources, City co-sponsored events/resources, and nonprofit organization events. Banner space for non-City banners shall not be reserved except through the issuance of a banner permit.

A. 
Banners proposed by events sponsored by the City or any City department shall have priority in reservation, provided such reservations shall be made no later than December 1st of the previous year. All other banner requests (including subsequent requests by the City) shall be reserved on a "first-come, first-served" basis.
B. 
Upon receipt of a completed banner application and permit request to hang a banner, the Community Services Department staff shall verify that the proposed banner complies with City policy and specifications.
C. 
A banner application and permit request shall be completed and issued, and all appropriate fees shall be collected at the time of issuance, before any banner is installed. Banner permit forms are located at the Community Services Department Office, 2001 East Street.
D. 
After a banner permit is completed, the original permit is routed to the Public Works Department. A copy is given to the permittee and one copy is filed in the Community Services Department banner permit file.
