a. There
is hereby established the Department of Technology in the County.
The Department of Technology shall oversee and be responsible for
the establishment, on a Countywide basis, for information technology
management to, within, and among County departments, including, but
not limited to, network design and support of the wide area network,
applications development, support of the County Enterprise Resource
Planning system, database administration and information reporting,
data center operations, operating system support, telecommunications
and the regional radio system as well as other shared services involving
information technology. The management information systems functions
and activities previously provided through the Municipal Services
Agency Office of Administration shall be incorporated within the duties
and responsibilities of the Department of Technology.
b. Any
provision of this code which refers to the Office of Communications
and Information Technology shall, instead, be deemed to refer to the
Department of Technology.

There is established within the Department of Technology the
position of Chief Information Officer. The Chief Information Officer
shall be the head of the Department of Technology, shall report directly
to the Office of the County Executive and shall, subject to the control
and direction of the County Executive, carry out the duties and responsibilities
of the Department and shall supervise and direct the work of the staff
assigned or loaned to the Department. The Chief Information Officer
shall be appointed by the County Executive, subject to confirmation
of the Board of Supervisors pursuant to the Charter and may be filled
by persons under contract to the County.

The Chief Information Officer shall have and exercise the following
duties and responsibilities:
1. To plan,
direct and control all of the activities of the Department of Technology;
2. To study
and make recommendations to the Board of Supervisors, County Executive
and County Departments on communications and information technology
needs and services;
3. To represent
Sacramento County in dealing with other agencies, organizations, groups
and individuals with respect to the providing of communications and
information technology services to or by the County;
4. To prepare
and justify an annual budget in accordance with established County
procedures;
5. To ensure
the security of all operations, files and records in the care, custody
or control of the Department;
6. To serve
as the County's Chief Information Officer and Chief Security Information
Officer;
7. To make
recommendations to the Board of Supervisors and County Executive regarding
priorities in providing communications and information technology
services and on the availability of resources to provide those services;
8. To perform
such other duties and activities as may be required or authorized
by the Board of Supervisors or County Executive;
9. The
Chief Information Officer, or his or her designee, shall serve as
the County's privacy official and contact person for receiving complaints
pursuant to the Health Insurance Portability and Accountability Act
and shall perform those duties as set forth in Section 164.530 of
Part 164 of Title 45 of the Code of Federal Regulations; and
10. The
Chief Information Officer, or his or her designee, shall also serve
as the County's security official pursuant to the Health Insurance
Portability Act and shall perform those duties as set forth in Section
164.308 of Part 164 of Title 45 of the Code of Federal Regulations.
