For the purpose of this chapter and the annual salary ordinance, the words and terms used shall have the meaning indicated as follows unless the context clearly indicates otherwise. Words used in the present tense include the future; words used in the masculine or feminine gender include the other gender and neuter; the singular number includes the plural and the plural includes the singular.

"Agency" means grouping of departments or lesser organizational units as established by the Board.

"Allocation" means the official determination of the class to which a position belongs, and the assignment of a position to its class.

"Appointment" means the offer to a person and that person's acceptance of, a position in accordance with this chapter.

"Appointing authority" means the person or group of persons having the lawful power to make appointments and to suspend, demote, reduce the compensation of, and remove persons from positions in the County service, and subordinates to whom such authority is delegated.

"Biweekly salary" means the amount of individual compensation, for a full biweekly pay period of service, which either is identified by a range and step in the standard salary schedule or is established specifically in the annual salary ordinance.

"Certification" means the submission of names of persons from an appropriate eligible list to an appointing authority by the Director of personnel management.

"CETA employee" means an employee who is appointed under the provisions of the Comprehensive Employment and Training Act into an authorized CETA position. Such positions are federally funded and are established as separate classes so as to be distinct from the regular County classes which bear the same class titles.

"Class" means a position or group of positions having comparable duties, responsibilities and qualifications which have been approved as a class by the Civil Service Commission and the Board of Supervisors.

"Class specification" means the official description of a class including:
1. 
The title;
2. 
A statement of the duties and responsibilities; and
3. 
The employment standards, such as education, experience, knowledge, skills and abilities, which may be required of applicants for employment in the class.

"Classification plan" means the arrangement of positions in classes, together with the titles and specifications describing each class.

"Daily rate" means the amount of individual compensation, for a full day's service, which either is computed by dividing monthly salary by the number of working days in a month or is specifically established in the annual salary ordinance.

"Demotion" means a change between classes where the maximum salary rate of a class to which the employee is appointed is one step (approximately 5 percent) or more lower than the maximum salary rate of the former class. Notwithstanding the foregoing, for purposes of layoff," demotion" means a change between classes where the maximum salary of the class to which the employee is changed is any amount less than the maximum salary of the class from which the employee is changed (the change is between classes in which the employee holds permanent status).

"Department" means a major organizational unit of the County government recognized as a department by the Board of Supervisors.

"Director" or "Personnel Director" means the Personnel Services Administrator or his or her designee.

"Eligible" means any person:
1. 
On a list of persons who have qualified by examination to be considered for appointment in a class;
2. 
On a reemployment list for a class;
3. 
On a medical center transfer list;
4. 
Eligible for reinstatement pursuant to Section 2.78.335;
5. 
Who previously held status in a class but demoted to a lower class in lieu of layoff, provided the person's County employment has been continuous.

"Examination" means a test given to determine whether applicants are qualified, consisting of:
1. 
Assembled Examination. An examination conducted at a specified time and place under the supervision of an examiner;
2. 
Unassembled Examination. An examination involving solely an appraisal of the relative qualifications of applicants without requiring them to appear in a group at specified places.

"Extra help employee" means any employee who is employed for a period of short duration, whether parttime or full-time, in a position which either is designated as extra help in the annual salary ordinance or is not contained therein.

"Flat rate" means the rate of compensation for a class, which is established specifically in the annual salary ordinance rather than in accordance with the standard salary schedule.

For purposes of layoff, "former class" means a class in which an employee previously has held permanent status. An employee may have one or more former classes. However, only those classes in which the employee has held permanent status during the current period of continuous service are eligible former classes in respect to a right to demote pursuant to layoff.

"Hourly rate" means the amount of individual compensation, for a full hour's service, which either is computed by dividing monthly salary by the number of working hours in a month or is specifically established in the annual salary ordinance.

"Layoff" means the involuntary termination from a class of a permanent or probationary employee without fault on the part of the employee, because of lack of work, lack of funds, or in the interest of economy.

"Leave of absence" means permission to be absent from duty for a specified period of time and for a specified purpose, with the right to return as provided in the approved leave.

"Limited term employee" means a person who accepts a limited term appointment as defined in Section 7.7(f) of the Civil Service Commission Rules. A limited term employee is a temporary employee for purposes of separation from County employment. However, in the event of such separation, a permanent employee appointed to a limited term position shall have return rights, within the same department, from the limited term position to the permanent position.

"Medical Center employee" means a County employee assigned to the Sacramento Medical Center, who on June 30, 1973, was employed by the County and assigned to the Sacramento Medical Center, and who exercised, by March 31, 1973, an option to remain a County employee subsequent to July 1, 1973, pursuant to paragraph 29(c) of that agreement dated November 20, 1972, between the County and the Regents of the University of California, entitled "Agreement Providing for Transfer of Operation, Control and Ownership of the Sacramento Medical Center."

"Medical Center transfer list" means a listing of those employees described in Section 2.78.250 above, who hold positions in classifications which also exist in departments other than the medical center.

"Indigent defense program employee" means an employee who previously was employed by the Sacramento County Superior Courts as of November 1, 2000 and who, as of that date, exercised an option to become a County employee.

"Monthly salary" means the amount of individual compensation, for a full month of service, which is established specifically in the annual salary ordinance.

"New child" means a new dependent through birth, adoption, foster care, or for whom one acts "in loco parentis". Dependent must be under the age of 18 years, or over age 18 but incapable of self care due to a physical or mental disability.

"Permanent position" means any position established in the annual salary ordinance, excepting any position established to accomplish a specific project which is limited in its duration.

"Position" means any combination of duties regularly assigned to be performed by one person.

"Probationary period" means the period of continuous service following appointment from an eligible list to a class in the civil service and prior to obtaining permanent status in the class.

"Promotion" means advancement from a position in one class to a position in a higher class, defined as one having a maximum salary rate at least one step (approximately five percent) higher than the employee's former class.

"Provisional appointment" means the appointment of a qualified person to fill a position for which no appropriate reemployment or eligible list exists, pending an examination.

"Qualified" means an applicant or appointee who meets the employment standards for a class.

"Range" means a sequence of salary steps used to identify the minimum, maximum and intermediate salary rates in the standard salary schedule which may be paid to employees within a class.

"Reemployment list" means a list of persons who formerly held permanent status in a class who have been laid off and who are entitled to preference in appointment to vacancies in that class.

"Regular employee" means any officer or employee, in civil service or not in civil service, who occupies a permanent position, whether part-time or full-time, established in accordance with the annual salary ordinance, in the class which is intended for permanent or career-type employment; any officer or employee of the municipal court or Marshal's Department who, pursuant to Sections 72150 and 72151 of the Government Code, is appointed to a position approved by the Board of Supervisors in the annual salary ordinance, subject to approval of the State Legislature; any elected official and any exempt deputy or assistant; and any regular employee who temporarily transfers to a temporary position.

"Resignation" means the voluntary action of an employee which separates the employee from the employee's position.

"Scale" means the rate of compensation for a class, when specified in the annual salary ordinance, which is based upon union trade rates, less any amount determined to be the value of vacation, sick leave, overtime, health and welfare pension and miscellaneous benefits.

"Serious health condition" is a long term illness or medical condition in which the patient is hospitalized, or for which recurring treatment is necessary, under the supervision of a health care professional.

"Separation" means any termination of employment. Separation from employment of a temporary employee or the return of a regular employee from a temporary upgrade to the immediate former class in which the employee held permanent status does not constitute a layoff.

"Spouse" means any person recognized as such by the State of California.

"Status" means the employee's current appointment, such as permanent, temporary, provisional or probationary. Temporary includes intermittent and limited term.

"Step" means one of the salary rates identified in the standard salary schedule by the numbers "2", "3", "4", "5", "6", "7", "8", or "9", which are used to identify the specific compensation of an employee within the established range for the employee's class.

"Suspension" means an involuntary absence without pay imposed by the appointing authority or other authorized person for disciplinary purposes.

"Temporary employee" means an employee who has been appointed from a list of eligibles, or provisionally, in the absence of a list, to a position which is other than a permanent position.

"Transfer" means a change between positions within two departments which positions are in the same class or between classes where the maximum salary rate of the class to which transferred is less than one step (approximately five percent) higher or is less than one step (approximately five percent) lower.
