As used in this chapter:
A. "Applicable
agencies" mean each department, agency, commission, board, office
or dependent district of the County whose budget includes funding
for physical improvements.
B. "Physical
Improvements" mean any new construction or renovation that adds value
to an applicable agency's assets costing in excess of $50,000 for
the Department of General Services and the Department of Regional
Parks, and costing in excess of $100,000 for all other applicable
agencies, exclusive of the following:
1. Projects
which the Board of Supervisors or the Deputy County Executive of Community
Services determine, in cases of emergency, are necessary for the continued
conduct of County operations or services, or to avoid danger to life
or property;
2. Improvements
constructed pursuant to the provisions of the Improvement Act of 1911,
the Municipal Improvement Act of 1913, the Mello-Roos Act, or other
similar assessment district Acts.

The County Executive shall develop and determine the format
of the capital improvement program, and shall issue such written instructions
and forms as are deemed necessary to elicit from the applicable agencies
sufficient information to prepare his or her recommendations to the
Board for a capital improvement program.

The County Executive shall transmit to all applicable agencies
materials necessary for preparation of their requests to construct
physical improvements during the next capital improvement program
period; and on such date as the County Executive specifies all applicable
agencies shall file completed proposals for physical improvements
with the County Executive.

The County Executive shall review the proposals submitted by the applicable agencies. From those submittals, the County Executive shall compile and transmit to the Board of Supervisors a separate report of all new Physical Improvements or newly funded physical improvements prior to the County's Recommended Budget Hearings and with sufficient time for review by the Sacramento County Planning Commission. The Board of Supervisors shall refer the proposed new physical improvements or newly funded physical improvements in the capital improvement program to the County Planning Commission for review as defined in Section
21.15.050.
After review by the County Planning Commission, the County Executive
shall compile his or her recommendations into a single capital improvement
program document, inclusive of new and newly funded physical improvements,
and ongoing physical improvements, which shall be transmitted to the
Board of Supervisors along with the County Executive's Recommended
Budget.

The County Planning Commission shall review the proposed new
physical improvements and newly funded physical improvements in the
capital improvement program as to consistency with the adopted County
General Plan and report with its recommendation as to consistency
to the Board. Such review by the County Planning Commission may include
consideration of pertinent technical information, but the County Planning
Commission shall not be required to hold a public hearing thereon.
Failure of the County Planning Commission to report its recommendation
to the Board within 40 days from receipt thereof shall be deemed a
recommendation that the proposed projects in the capital improvement
program are consistent with the adopted General Plan.

The Board of Supervisors, as the planning agency, shall review
the capital improvement program, consider the recommendations of the
Planning Commission and staff, and determine the consistency of the
proposed physical improvements in the capital improvement program
with the General Plan prior to the appropriation of funds for any
proposal contained in said program. Notwithstanding any other provisions
of this chapter, the Board reserves to itself total authority to establish
priorities for the scheduling of the physical improvements within
the capital improvement program and to determine the appropriateness
of funding for such physical improvements. Board of Supervisors approval
of funding for a physical improvement in the County's budget shall
also be considered approval of a physical improvement for purposes
of inclusion in the Capital Improvement Program.

Amendments to the capital improvement program may occur from
time to time throughout any fiscal year by action of the Board of
Supervisors upon recommendation by any of the applicable agencies.
New physical improvements or newly funded physical improvements shall
be submitted to the Planning Commission for review to determine consistency
with the Adopted General Plan prior to recommendation to the Board
of Supervisors. The determination shall be included within the discussion
presented to the Board of Supervisors.
