A. Centers
for the protection of homeless individuals and families during inclement
weather is vital, whether due to extreme cold, extreme heat, poor
air quality conditions, severe storms, or other types of civil emergencies.
B. The
city council has, from time to time in the past, passed resolutions
stating the guidelines and triggering conditions for the activation
of emergency warming centers in the city of Manteca, noting that extreme
weather conditions can create an extreme danger for homeless people
in Manteca and puts a great strain on service providers.
C. An inclement
weather center can be located or constructed on any land owned or
leased by the city of Manteca or the successor agency to the Manteca
Redevelopment Agency, including land acquired with low- and moderate-income
housing funds.

A. The
activation criteria for inclement weather centers in the city of Manteca
is as follows:
1. A
private nonprofit organization filing a 501(c)3 with the state may
apply with the city of Manteca to activate an inclement weather center
on city or successor agency owned property and the city may approve
the use as temporary use via a temporary use permit.
2. Warming
centers can be established with an approved temporary use permit between
the dates of December 1 and March 31; and any other day during which
the temperature is predicted by the National Weather Service to be
forty degrees Fahrenheit or lower as a daily low and designated shelter
space within the City was at ninety percent capacity or greater during
the previous night. The city may, upon request by a center provider,
raise the activation temperature for warming centers, but in no event
will the activation temperature be higher than fifty-two degrees Fahrenheit.
3. Cooling
centers can be established with an approved temporary use permit and
activated when the temperature is predicted by the National Weather
Service to be one hundred degrees Fahrenheit or higher for three consecutive
days or more.
4. Safe
air centers can be established with an approved temporary use permit
and activated for any day on which the San Joaquin Valley Unified
Air Pollution Control District forecasts the current air quality index
to reach two hundred fifty or higher.
5. Wind
shelter centers can be established with an approved temporary use
permit and activated when Manteca is subject to sustained winds of
over twenty mph.
6. A
temporary use permit may be approved for an inclement weather center
and be activated by the city manager or city manager's designee on
city or successor agency owned property any day in which a civil emergency
or extreme storm or weather condition exists or is predicted to occur
and which, in the determination of the city manager or city manager's
designee, poses a severe threat to the health or safety of homeless
individuals and families in the city of Manteca.
7. The
operation of an inclement weather station shall comply with all life
and safety codes to the satisfaction of the city manager or designee.
B. The
city manager shall implement the appropriate policies and procedures,
including, without limitation, partnering with inclement weather center
providers for grant funding requests; the designation of specific
locations to be used as warming, cooling, safe air and wind shelter
centers; and the arrangement of other appropriate measures and conditions
to the city council in order to carry out the specific provisions
and intent of this section.
