The following definitions shall apply to the terms used in this
chapter:
"Deliver" and "delivery"
mean throwing, casting, distributing, scattering, depositing,
passing-out, giving away or circulating.
"Disseminator"
means the owner, publisher or deliverer of the printed matter.
"In defiance of the previously expressed will of the occupant"
means:
1.
The building or property has been conspicuously posted with
a sign approved and distributed by the police chief or his or her
designated representative prohibiting the delivery of printed matter;
or
2.
The occupant of the building or possessor of the property has
previously instructed the disseminator to discontinue or refrain from
delivering printed matter.
"Printed matter"
means handbill, dodger, circular, newspaper, paper, booklet,
book or poster.
"Property"
means building, vacant lot or other private property.

A. No person
shall deliver any printed matter to or on any property in defiance
of the previously expressed will of the occupant or possessor of the
property.
B. No person
shall deliver any printed matter to or on any property where it is
apparent to a reasonable person that the property is vacant.
C. No person
shall deliver or cause to be delivered any printed matter to any property
in the city except as follows:
1. By
placing the same in a receptacle, clip or other device designed or
intended to receive it when such receptacle, clip or other device
is erected in a conspicuous place near the front door or front entrance
or near the mailbox of any property;
2. If
no receptacle, clip or other device exists, then by placing the printed
matter on the porch or vestibule of a building on the property; provided,
that it is wrapped, tied or lock-folded, or is placed within the outer
door or in the door jamb or door handle; or
3. By
handing the same from person to person.
D. No person
shall place or cause to be placed any printed matter upon any motor
vehicle. This subsection shall not apply to the issuance of any traffic
citation, tow away notice, or other notice permitted or required by
law.
E. Nothing
in this section shall apply to U.S. Postal Service mail carriers delivering
the mail.
