1. 
All buildings and structures within the Borough Historic District shall be maintained in good repair, structurally sound and reasonably protected against decay and deterioration. Deterioration includes but is not limited to:
A. 
Deterioration of exterior walls or other vertical supports.
B. 
Deterioration of roofs or other horizontal members.
C. 
Deterioration of exterior chimneys.
D. 
Deterioration or crumbling of exterior stucco or mortar.
E. 
Ineffective waterproofing of exterior walls, roofs or foundations, including broken window or doors.
F. 
Deterioration of any feature so as to create a hazardous condition, which could lead to the claim that a demolition is necessary for the public safety.
G. 
Lack of gutters, downspouts and/or flashing and sealant permitting water penetration.
H. 
Lack of paint permitting water penetration of wood or rusting of metals.
2. 
Failure to maintain a building or structure in good condition, structurally sound and reasonably protected against decay and deterioration shall be considered demolition by neglect and a violation of this Chapter.

In the event the Zoning Officer determines that a violation to §11-901 has occurred, the Zoning Officer shall issue a notice of violation to the property owner and notify HARB. HARB shall review the violation and submit a written finding to the Borough Council. The finding shall include recommendations immediately necessary for the preservation of the building or structure.

Upon receipt of the written finding of HARB, Borough Council shall consider at its next scheduled meeting or the one thereafter, if the next would make three working days’ notice to the owner of record impossible, the written finding of HARB. The Borough Secretary or his/her designee shall provide said notice by certified mailing to the last known address of the owner of record and to the address listed in the tax records. If certified notice cannot be secured, the notice shall be posted on the front door or similar secure place.

The owner of record shall be given three working days' notice by the Borough Secretary or his/her designee of the time and place of the meeting at which the written finding by HARB will be considered and shall have the right to attend and be heard regarding the finding. Within the three working days, the owner of record has the right to request a change of hearing date if it is impossible for him/her to attend the meeting proposed by the Borough.
4. 
The Historic Building Inspector shall attend the meeting and present HARB’s finding. The owner of record or his representative may present any rebuttal thereto.
