The purpose of this article is to provide appropriate standards
and regulations for the keeping of certain farm animals for noncommercial
purposes within a residential environment so as to avoid adverse impacts
on neighboring properties and residents.
As used in this article, the following terms shall have the
meanings indicated:
Female chickens or hens.
Any camelid or hooved animal raised for domestic or commercial
use, including but not limited to horses, mules, llamas, alpacas,
cattle, sheep, goats and swine, including miniature and potbellied
pigs.
Any species of domestic fowl, including roosters, turkeys,
ducks, geese, peafowl, ostriches, emus, waterfowl and game birds,
except chickens (females or hens), as defined herein, are excluded.
No person shall shelter, maintain, keep or harbor any livestock
or poultry on any property within the City of Atlantic City.
The keeping of chickens on properties located within the City
of Atlantic City shall be permitted in accordance with the following
regulations and conditions:
A.
A maximum
of five chickens shall be permitted on any parcel of land in contiguous
ownership regardless of lot area.
B.
The
keeping of roosters is expressly prohibited.
C.
All
chickens shall be securely confined within a structure or enclosure
surrounded by a secure fence of sufficient height and strength to
confine the chickens and serve as protection from weather and predators.
D.
All
such structures or enclosures shall be screened from view from the
street.
E.
All
such structures and enclosures shall be kept in a clean, healthy and
sanitary condition by the person possessing or occupying the property,
and no person shall permit any noise, odor or other nuisance to be
formed or maintained.
F.
All
structures and enclosures shall require an accessory building permit
and shall adhere to all zoning requirements, including the requirements
for accessory structures.
G.
Any
persons keeping chickens shall be required to obtain a license from
the appropriate licensing division of the City.
The provisions of this article shall be enforced by the City Construction Official, City Zoning Officer, City Code Enforcer, City Police Department and City Health Officer. Any person, firm or corporation violating any of the provisions of this article shall be subject to the penalties provided in § 121-27 of the Revised Ordinances of the City of Atlantic City. Each and every violation of this article and each and every day that any violation of this article shall continue shall be construed as a separate and distinct violation.
