A. 
Sales from ice cream trucks shall be limited to streets that have a 35 mile per hour or less speed limit.
B. 
The parking restrictions set forth in Chapter 10.36, including Section 10.36.010(A) of this code, shall apply to the operation of every ice cream truck.
C. 
No sale shall be made while an ice cream truck is parked within 75 feet of any intersection with any public street or streets as measured along the traveled way.
D. 
Standard warning flashers shall be in operation immediately upon the truck stopping to vend and shall cease operating as the truck begins to move after vending.
E. 
Pursuant to the authority set forth in California Vehicle Code Section 22455(b), no sale shall be made while an ice cream truck is parked less than 200 feet from the closest boundary of a public school or park.
F. 
Vending may only occur to the rear or on the passenger side of the ice cream truck.

A. 
No person shall use, play, or employ any sound, outcry, amplifier, loudspeaker, or any other instrument or device for the production of sound from an ice cream truck for the purpose of selling or promoting any product when the ice cream truck is stationary.
B. 
No person shall use, play or employ any sound, outcry, amplifier, loudspeaker, or any other instrument or device for the production of sound from an ice cream truck for the purpose of selling or promoting any product after 7:00 p.m. or one-half hour after sunset, whichever occurs first.
C. 
No person shall use, play, or employ any sound, outcry, amplifier, loudspeaker, or any other instrument or device for the production of sound employed on an ice cream truck in such a manner as to create a disturbance of the peace or where the same violates any local or state law governing permissible noise levels.

No ice cream truck driver shall stop to vend from an ice cream truck within 200 feet of another ice cream truck that has already stopped to vend.

A person may sell or offer for sale only prepackaged ice cream or other frozen dessert from an ice cream truck and may not give away, sell or offer for sale any other items. All food items shall be handled, packaged, stored and offered for sale in accordance with all applicable provisions of state law including, but not limited to, the provisions of Part 7 of Division 104 of the California Health and Safety Code.

A. 
No one other than one driver and one additional person shall be allowed to ride on an ice cream truck that is in operation.
B. 
The driver and the additional person may only be:
1. 
Employees of the business operator; or
2. 
The business operator; or
3. 
A trainee.

A. 
All ice cream trucks used for vending within the city shall comply with any and all Vehicle Code requirements and shall, at all times, be maintained in a safe, clean, sanitary, and properly functioning condition. In furtherance thereof, the brakes and lamps of all such trucks shall be inspected for legal compliance and certified annually by a facility licensed to perform such inspections by the State Department of Consumer Affairs, Bureau of Automotive Repair.
B. 
Each ice cream truck operator shall obtain and maintain a city business license. No business license shall be issued unless at the time of application the operator presents a current inspection certificate, as referred to in subsection A of this section.
C. 
It is unlawful for an ice cream truck operator to operate an ice cream truck that does not have on board the current, written certification, or copy thereof, as required by subsection A of this section.
D. 
Each ice cream truck operator shall, at all times, maintain each ice cream truck as follows:
1. 
All doors, windows, hood and trunk shall open and close securely;
2. 
The inside of the ice cream truck shall be clean, sanitary and free of litter and trash;
3. 
A trash receptacle shall be accessible to the public when sales occur in which patrons can place package wrappers and trash;
4. 
The exterior of the ice cream truck shall be clean and in good repair, and shall not have any peelings, dents, rust, scratches or missing components which are discernible at a distance of five feet or more from the truck;
5. 
Decals advertising products and price lists shall be placed only on the rear and/or passenger side of the ice cream truck and shall use a maximum area of 24 square feet; and
6. 
The refrigeration system shall properly function.
E. 
The ice cream truck operator shall have and maintain in clean condition on each ice cream truck the following safety features:
1. 
Signs painted or mounted on the front and back of each truck using the black four-inch tall letters on a yellow background with a black one inch border around each sign. The sign on the front and back of each truck shall read "CHILDREN CROSSING" and shall be no less than eight inches high by 48 inches wide. An additional sign or signs of the same size shall be painted or mounted on the rear of each truck above the first sign and shall read 'WARNING' in English and Spanish using the same size letters and paint color.
2. 
Properly functioning standard warning flashers.
3. 
Any other properly operating safety equipment required by the California Vehicle Code.

Each ice cream truck operator shall cause an identification number, provided by the Upland police department's traffic division, to be painted on the sides and back of each ice cream truck. The number shall be of such color, size and placement that it may be easily read at a distance of 10 feet. In addition, each ice cream truck operator shall, at the time of applying for a business license and the renewal thereof, provide a list of all ice cream truck drivers' name and home addresses. The list shall be amended by the operator within five business days of any change of drivers.
