The adoption of this article is in accordance with New York
Municipal Home Rule Law, including § 10 thereof, and expressly
supersedes any provision of Town Law which is contrary to this article,
including but not limited to §§ 20 and 37 thereof.
The Walworth Town Board finds that it would be to the benefit
of the public to abolish the Office of the Receiver of Taxes and Assessments
of the Town of Walworth and transfer the powers and duties thereof
to the Office of the Town Clerk of the Town of Walworth, primarily
because it would allow much greater access to the public to those
services customarily provided by the Office of the Receiver of Taxes
and Assessments, given that the current Office of the Receiver of
Taxes and Assessments is limited in the hours in which it is open
to the public, while the Office of the Town Clerk is generally open
and available to the public during regular business hours. Moreover,
by combining two offices into one, the Town Board is hopeful that
certain efficiencies might be realized, including the likelihood that
modest cost savings could be achieved.
The Office of Receiver of Taxes and Assessments of the Town
of Walworth, New York, is abolished as of January 1, 2024 (i.e., at
the end of the calendar year of 2023). Contemporaneous with such abolishment,
the powers and duties of that Office shall be transferred to the Office
of the Town Clerk of the Town of Walworth, New York.
Should any word, section, clause, paragraph, sentence, part
or provision of this article be declared invalid by a court of competent
jurisdiction, such determination shall not affect the validity of
any other part hereof.
All other ordinances or local laws of the Town of Walworth which
are in conflict with the provisions of this article are hereby superseded
or repealed to the extent necessary to give this article force and
effect during its effective period.
This article is subject to mandatory referendum at the 2023
General Election.
This article shall take effect upon the affirmative vote of
a majority of the qualified electors voting thereon at said election
and the filing of this article with the Office of the Secretary of
State in accordance with the applicable provisions of law.
