The electors of the City of Encinitas shall elect one Mayor and four Council Members pursuant to Sections 2.20.080 and 2.20.090. General municipal elections are held every two years in even-numbered years. The general municipal election shall be consolidated with the statewide general election. The Mayor and City Council Members will be installed the second Tuesday of December in even-numbered years.

A. 
City Council Members are elected to serve a term of four years. After 2016 (see Section 2.20.011 of this chapter), Council Members' terms shall be evenly staggered with two Council Members' terms expiring in each even-numbered year.
B. 
The City Council shall be the legislative body with the exclusive and original jurisdiction to interpret and govern all matters described and/or set forth within City ordinances, resolutions, codes, and other regulatory directives adopted previously by the Council by reference or currently applicable to any activity, event, request, forbearance and/or issue raised of any nature within the boundary of the City.
C. 
In the case of a vacancy on the City Council, for any reason, the Council shall fill the vacancy by appointment. If the Council fails to fill the vacancy within 60 days, it shall call an election to be held not less than 114 days thereafter. A person appointed or elected to fill a vacancy shall hold office for the unexpired term of the former incumbent.

A. 
The Mayor is elected and shall serve a term of two years, beginning with the November 4, 2014, general municipal election.
B. 
The Mayor shall be the presiding officer of the City Council.
C. 
The Mayor is a member of the City Council with all the powers and duties of a member of the City Council. The Mayor may make or second motions and otherwise participate fully in the workings of the City Council. The Mayor shall vote on all questions. Whenever the vote is taken by means of a roll call, the Mayor's name shall be called last.
D. 
The Mayor shall be the official head of the City for all ceremonial purposes, and shall perform all other duties as may be prescribed by ordinance or by the Council consistent with the office.
E. 
The Mayor shall sign all:
1. 
Warrants drawn on the City Treasurer;
2. 
Written contracts and conveyances made or entered into by the City; and
3. 
Instruments requiring the City Seal (the Council may provide by ordinance that the instruments described above be signed by an officer other than the Mayor).
F. 
The Mayor may administer oaths and affirmations, take affidavits, and certify them.
G. 
The Mayor may acknowledge the execution of all instruments executed by the City and required to be acknowledged.
H. 
The Mayor, with approval of the City Council, shall make all appointments to boards, commissions, and committees unless otherwise provided by statute.
I. 
In the case of a vacancy in the office of Mayor for any reason, the Council shall fill the vacancy by appointment. If the Council fails to fill the vacancy within 60 days, it shall call an election to be held not less than 114 days thereafter. A. 
At the first regular City Council meeting in December of odd-numbered years and the second Tuesday of each December in even-numbered years, the City Council shall choose one of its members as Deputy Mayor.
B. 
The Deputy Mayor shall serve a term of one year, or until a successor is chosen and rotated annually. Three affirmative votes shall be required to choose or change the Deputy Mayor as established by resolution.
C. 
In addition to the powers and duties of a Council Member, in the Mayor's absence, the Deputy Mayor shall be the presiding officer of the City Council.

A. 
The Mayor shall be entitled to the same salary as a Council Member plus $100.00 per month and the operative date of this compensation adjustment shall take effect upon the seating of the legislative body after the general municipal election held in November 2018.
B. 
Each Council Member shall be entitled to a salary in the amount of $1719.70 per month. The operative date of the compensation adjustment shall take effect upon the seating of the City Council legislative body after the general municipal election held in November 2018.
C. 
Upon the submission of an itemized account, the Mayor and Council Members may be reimbursed for the actual and necessary expenses incurred in the performance of official duty.

A. 
Regular meetings of the City Council shall be held on the second, third, and fourth Wednesday of each month. Regular meetings shall commence at 6:00 p.m.
B. 
The City Council may, by resolution, designate another date, time and location for a regular meeting.

The City Council may, from time to time, adopt by resolution, rules of procedure for the conduct of meetings. These resolutions shall be compiled and maintained by the City Clerk and made available to the public and to the City Council during every meeting.
A. 
Any person who fails to comply with a direction given by the presiding officer for the purpose of maintaining order at a City Council meeting shall be guilty of a misdemeanor.
B. 
All persons shall comply with the meeting procedures announced by resolution of the City Council and no person shall interfere with or interrupt a City Council meeting.
C. 
The presiding officer may designate a member of the County Sheriff's Department as sergeant at arms who shall carry out the directions of the presiding officer to include making arrests as directed by the presiding officer.
A. 
Unless otherwise prescribed by state law, in December of each year, the Mayor, with City Council approval, shall make all appointments to outside boards, commissions, and committees. If otherwise provided by statute, the Council will make the appointment.
B. 
At the first meeting in December of each year, the Mayor and Council shall review and discuss the list of outside appointments for representation on other boards, commissions, and committees. At the second meeting in December of each year, the Mayor, with City Council approval shall make all appointments to outside boards, commission and committees.
C. 
Each selection shall be based upon a recommendation made by motion of the Mayor, seconded, and adopted by a majority of the City Council.

A. 
Pursuant to California Government Code Sections 34886 and 34871(c), Council Members shall be elected by-districts in four single-member districts. The Mayor will be separately elected by a citywide vote.
B. 
1. 
Beginning with the general municipal election in November 2018, Council Members shall be elected in the electoral districts reflected on the map contained in Figure 1 and as subsequently reapportioned as provided by State law. Elections shall take place on a by-district basis as that term is defined in California Government Code Section 34871, meaning one member of the City Council shall be elected from each district, by the voters of that district alone, except for the Mayor, who shall be elected citywide. In accordance with Section 2.20.015(A), and except as provided in Section 2.20.011, each Council Member, except the Mayor, shall serve a four-year term until his or her successor has qualified.
2. 
Except as provided in subsection (B)(3), the Council Member elected to represent a district must reside in that district and be a registered voter in that district, and any candidate for City Council must live in, and be a registered voter in, the district in which he or she seeks election at the time nomination papers are issued, pursuant to California Government Code Section 34882 and Elections Code Section 10227. Termination of residency in a district by a Council Member shall create an immediate vacancy for that Council district unless a substitute residence within the district is established within 30 days after the termination of residency.
3. 
Notwithstanding any other provision of this section, each of the Council Members in office at the time this chapter takes effect shall continue in office until the expiration of the full term to which he or she was elected and until his or her successor is qualified, except as otherwise provided in Section 2.20.011. Vacancies in Council Member offices elected at-large may be filled from the city at-large. At the end of the term of each Council Member, that Member's successor shall be elected on a by-district basis in the districts established in subsection A and the map contained in Figure 1 (Citizen Map 016), as subsequently reapportioned as provided by State law. A vacancy in a Council Member office elected by-district shall be filled by a person qualified to hold the office, who is a resident of the district.

A. 
Consistent with Section 2.20.011, Council Members shall be elected in Council Districts 3 and 4 beginning at the general municipal election in November 2018, and every four years thereafter.
B. 
The Council Members from Council Districts 1 and 2 shall be elected beginning at the general municipal election in November 2020, and every four years thereafter.
