The electors of the City of Encinitas shall elect one Mayor and four Council Members pursuant to Sections
2.20.080 and
2.20.090. General municipal elections are held every two years in even-numbered years. The general municipal election shall be consolidated with the statewide general election. The Mayor and City Council Members will be installed the second Tuesday of December in even-numbered years.

For the 2016 general municipal election only, the candidate
elected who received the least votes shall serve a two-year term,
and in the event of a tie for second place, the two-year term seat
shall be decided by lot.

A. The
Mayor is elected and shall serve a term of two years, beginning with
the November 4, 2014, general municipal election.
B. The
Mayor shall be the presiding officer of the City Council.
C. The
Mayor is a member of the City Council with all the powers and duties
of a member of the City Council. The Mayor may make or second motions
and otherwise participate fully in the workings of the City Council.
The Mayor shall vote on all questions. Whenever the vote is taken
by means of a roll call, the Mayor's name shall be called last.
D. The
Mayor shall be the official head of the City for all ceremonial purposes,
and shall perform all other duties as may be prescribed by ordinance
or by the Council consistent with the office.
E. The
Mayor shall sign all:
1. Warrants
drawn on the City Treasurer;
2. Written
contracts and conveyances made or entered into by the City; and
3. Instruments
requiring the City Seal (the Council may provide by ordinance that
the instruments described above be signed by an officer other than
the Mayor).
F. The
Mayor may administer oaths and affirmations, take affidavits, and
certify them.
G. The
Mayor may acknowledge the execution of all instruments executed by
the City and required to be acknowledged.
H. The
Mayor, with approval of the City Council, shall make all appointments
to boards, commissions, and committees unless otherwise provided by
statute.
I. In the
case of a vacancy in the office of Mayor for any reason, the Council
shall fill the vacancy by appointment. If the Council fails to fill
the vacancy within 60 days, it shall call an election to be held not
less than 114 days thereafter. A person appointed or elected to fill
a vacancy shall hold office for the unexpired term of the former incumbent.

A. The
Mayor shall be entitled to the same salary as a Council Member plus
$100.00 per month and the operative date of this compensation adjustment
shall take effect upon the seating of the legislative body after the
general municipal election held in November 2018.
B. Each
Council Member shall be entitled to a salary in the amount of $1719.70
per month. The operative date of the compensation adjustment shall
take effect upon the seating of the City Council legislative body
after the general municipal election held in November 2018.
C. Upon
the submission of an itemized account, the Mayor and Council Members
may be reimbursed for the actual and necessary expenses incurred in
the performance of official duty.

The City Council may, from time to time, adopt by resolution,
rules of procedure for the conduct of meetings. These resolutions
shall be compiled and maintained by the City Clerk and made available
to the public and to the City Council during every meeting.
A. Unless
otherwise prescribed by state law, in December of each year, the Mayor,
with City Council approval, shall make all appointments to outside
boards, commissions, and committees. If otherwise provided by statute,
the Council will make the appointment.
B. At the
first meeting in December of each year, the Mayor and Council shall
review and discuss the list of outside appointments for representation
on other boards, commissions, and committees. At the second meeting
in December of each year, the Mayor, with City Council approval shall
make all appointments to outside boards, commission and committees.
C. Each
selection shall be based upon a recommendation made by motion of the
Mayor, seconded, and adopted by a majority of the City Council.
