Because of the potential of urine or feces to spread disease
if not disposed of in a sanitary manner, and because of the negative
esthetic impact of public urination or defecation either by sight
or by smell, the declared purpose of this chapter is to prohibit public
urination or defecation in the City of Encinitas.

No person shall urinate or defecate in or on any street, sidewalk,
alley, plaza, park, beach, public building or publicly maintained
facility, or in any place open to the public or exposed to public
view. This section shall not apply to urination or defecation which
is done in any fixture provided for such purposes in any restroom
or other public facility designed for the sanitary disposal of human
waste. Any person who violates this section is guilty of a misdemeanor.
