It is the purpose of this title to provide a reference for employees from which they may understand the overall personnel structure, and provide a reference for related policies and procedures.

It is the purpose of this chapter to generally outline the positions of employment within the City of Encinitas.

Annual Leave.
Accrual of time which allows employees to be absent from work.
Appointment.
The employment of a person in a position.
Appointing Authority.
The officer(s) of the City who have authority to make appointments to positions to be filled.
Categories of Position.
The grouping in which a position of employment is located.
Date of Appointment.
The date of an employee's original appointment to the City service. This date is used principally in matters regarding annual leave, the accrual of units of benefit under the income protection plan, and other related personnel actions.
Full-time Employee.
An employee who is scheduled to work a minimum of 40 hours a week.
Income Protection Plan.
A plan which provides continued compensation for a limited time period for employees who are incapacitated by an illness.
Part-time Employee.
An employee who is scheduled to work less than 40 hours a week.
Personnel Officer.
The City Manager or his/her designee.
Personnel Ordinance.
The ordinance which creates a personnel system for the City.
Position of Employment.
The established title, category and pay range of a City position.
Position Specification.
A written description of the qualification requirements, desired qualifications, main characteristics, knowledge, skills, abilities, and duties of a position of employment (reference Section 12.08.060).
Regular Appointment.
Appointment to a position with no fixed term of employment.
Reserve Appointment.
Appointment to a position for a limited term.

The City Manager or his/her designee shall be the personnel officer for the City.

A. 
Positions of employment with the City shall be created by resolution of the City Council setting forth:
1. 
Title.
2. 
Pay range.
B. 
The City Manager shall assign and reassign created positions and incumbents to departments.
C. 
The City Manager may combine part-time positions to form a full-time position; and may divide a full-time position into part-time positions.
D. 
The City Manager shall assign and reassign created positions to categories for the purpose of implementing all personnel policies and rules.

The following are the categories of positions of employment with the City:
A. 
The "City Manager" whose terms and conditions of employment are fixed by contract and not by the provisions of this title unless the provision is expressly incorporated into the contract.
B. 
Executive.
C. 
Management.
D. 
Professional.
E. 
General.

A. 
The two types of appointments to positions of employment are:
1. 
A regular appointment to work without a fixed term of employment, and
2. 
A reserve appointment to work for a limited term of employment.
B. 
An appointment to any position may be regular or reserve at the discretion of the appointing authority.
C. 
If the position of the executive for a department is vacant or if an executive is absent, the City Manager shall serve as the appointing authority for that department.

An employee wishing to leave City employment in good standing shall file with the appointing authority a written resignation stating the effective date and reasons for leaving at least two weeks before leaving the service, unless such time limit is waived by the appointing authority.
Failure to give notice as required by this section shall be cause for denying future employment by the City.

The Code of Ethics and Discipline shall be those provisions set forth in the Administrative Manual of the City of Encinitas.
