[Adopted 10-24-2023 by L.L. No. 8-2023]
The Town Board of the Town of Blooming Grove hereby finds and
determines that it is in the best interest of the residents of the
Town of Blooming Grove to find and appoint qualified people to Town
offices, including the Clerk to the Town Justice. The Town Board also
finds that the requirement that the Clerk to the Town Justice be a
Town resident and elector may limit the Board's ability to find
qualified people to fill that position. Therefore, the Town Board
hereby determines that the residency requirement for Clerk to the
Town Justice should include residents of the County of Orange, State
of New York.
The Clerk to the Town Justice shall reside within the County
of Orange, State of New York. There shall be no requirement that the
Clerk to the Town Justice reside in the Town of Blooming Grove and
be an elector of the Town.
This article is adopted pursuant to § 10 of the Municipal
Home Rule Law and is intended to supersede New York State Public Officers
Law § 3 and any other special law to the extent that such
special law may require the Clerk to the Town Justice to reside within
the Town of Blooming Grove and be an elector of the Town.
