"Tour bus" means any bus or other commercial vehicle operated
for hire to transport sightseers or tourists wherever licensed, exceeding
a maximum gross weight limit of three tons and used primarily for
transport of passengers for compensation. It does not include school
buses or buses transporting passengers over regular, scheduled routes
within Ojai where the routes are specifically designated by the California
Public Utilities Commission (PUC) or approved by the City or Gold
Coast Transit District.

It is unlawful for tour buses to park, stop or stand (except
when necessary to avoid conflict with other traffic or in compliance
with the directions of a peace officer or official traffic-control
device) anywhere in the City other than designated tour bus parking
areas as determined by the Public Works Department. The following
exceptions apply:
(b) Tour
buses may park, stop, or stand in a residential district no longer
than 15 minutes solely for the purpose of loading or unloading passengers,
then must travel to a designated tour bus parking area;
(c) Tour buses may park within the off-street parking areas of lawfully permitted hotels and motels as defined in Section
10-2.3203 where passengers stay overnight;
(d) Designated
tour bus parking areas where tour buses shall be allowed to stop,
stand, or park in designated parking areas established by the Public
Works Department on either a permanent or temporary basis.

The tour bus owner, representative of the owner, or person operating
the bus may be required to pay a fee for parking in a designated tour
bus parking stall. Said fee is to be established by the City Manager
or designee.

Copies of the ordinance codified in this article shall be sent to the California Public Utilities Commission and each tour bus company known by the City to operate within the City. The first time a tour bus is found operating in violation of the this, the driver shall be given a warning consisting of a copy of the ordinance codified in this article, and a written request that the ordinance and amendments be delivered to the management of the company operating the bus. Further violations may result in a citation issued to the tour bus company and the driver if they have been issued a previous warning. Additionally, any person violating any of the provisions of this chapter may be subject to the penalty provisions of Chapter 2, Title
1 of this Code. The remedies specified in this chapter shall be cumulative and the City may resort to any other remedy available at law or in equity and resort to any one remedy shall not cause an election precluding the use of any other remedy with respect to a violation.

The Director of Public Works is directed to place appropriate
signs, which will give reasonable notice of the tour bus parking areas
and parking restrictions.
