Any application claiming that the decision of the Planning Director or Planning Commission is unfair or causes excessive hardship to him or her may apply to the City Council without fee to approve an exception to this chapter. The City Council, in its discretion, may grant or deny such application with such conditions and modifications as it considers reasonable to carry out the purposes of this chapter. In exercising such discretion, the City Council shall be guided by the following standards and considerations:
(a) 
The magnitude of the proposed development and its effect upon the problems relating to growth management within the City.
(b) 
The stage of preparation of the applicant's proposed development and the timing of the application and prior approvals;
(c) 
The degree of certainty that applicants will be granted an allotment within the near future; and
(d) 
The hardship upon the applicant if the application is denied.
