Pursuant to Connecticut General Statutes § 4b-77(c) and Milford Zoning Regulations, Article V, § 5.1.10.9, any new commercial, mixed-use, or residential building or project requiring 30 or more parking spaces shall provide Level 2 or direct-current fast charging stations in the amount of at least 10% of those parking spaces.
The purpose of this Article VI is to prohibit the installation and operation of electric vehicle (EV) charging stations within underground parking garages within the City of Milford. This measure is taken to address potential safety and infrastructure concerns associated with the installation of such charging stations in underground facilities.
As used in this article, the following terms shall have the meanings indicated:
ELECTRIC VEHICLE (EV)
A vehicle that uses one or more electric motors or traction motors for propulsion.
UNDERGROUND PARKING GARAGE
A structure or facility constructed below the ground level for the parking and storage of vehicles.
(a) 
Except as set forth in Section 7-87(b) below, it shall be unlawful for any person, organization, or entity to install, operate, or maintain an electric vehicle (EV) charging station within any underground parking garage located within the boundaries of the City of Milford.
(b) 
Electric vehicle (EV) charging stations installed within any underground parking garage prior to the effective date of this Article VI shall be permitted to remain in use until such charging station requires replacement, at which time such charging station shall be removed.
Any person, firm or corporation who shall violate any provision of this Article VI shall be fined not less than $50 per day for the first 30 days from written offense and not less than $100 per day thereafter until the electric vehicle (EV) charging station has been removed from the underground parking garage. Each electric vehicle (EV) charging station shall constitute a separate offense for which fines may be imposed.
